A representative is not just a name on a document. With the e-Evidence Package, the role of the legal representative comes with real responsibility. For companies looking to comply, choosing a representative is not simply about finding a point of contact in the EU. It is about choosing a partner who understands the obligations and is prepared to take on that responsibility. At EDSR, part of the EDPO group, legal representation is our sole focus. Since 2018, we have been supporting organisations under European regulations and building the expertise needed to take on these roles. Because when responsibility is involved, experience matters.

  • "During its latest plenary, the EDPB has adopted guidelines on the application of the power to impose administrative fines in relation to other corrective powers under the GDPR and the final version of its guidelines on the interplay between the Digital Services Act (DSA) and the GDPR. Data Protection Authorities (DPAs) should follow a five-step methodology when deciding whether to impose an administrative fine: [...] The guidelines also provide an overview of the corrective powers within the remit of national DPAs and explain their purpose, scope, and how they relate to one another. Corrective measures include warnings, reprimands, orders, limitations (including bans), and the withdrawal of certification.   The Board also provides 14 practical examples illustrating how DPAs can assess the specifics of a case and decide which corrective measures should be imposed, if any. [...] After public consultation, the EDPB adopted the final version of its guidelines on the interplay between the DSA and the GDPR. The guidelines support the consistent application of both legal acts, particularly where DSA provisions concern the processing of personal data by intermediary service providers and refer to concepts and definitions laid down in the GDPR." #EU #DSA #GDPR #EDPB   *This article was not written by EDSR. Overwhelmed by EU regulations? You’re not alone. GDPR. DSA. AI Act. e-Evidence Package. For companies based outside the EU, each new framework brings new questions: Does it apply to us? What are our obligations? Where should we start? At EDPO, we understand these challenges because we work with these regulatory frameworks every day. Our focus remains clear: we provide representative services under European regulations. We don’t handle implementation work, but we can help organisations understand their obligations and connect them with trusted partners for additional support. #EDPO #EUCompliance #DigitalRegulation #DataProtection #eEvidence #GDPR

  • "Apple is facing another battle over its App Tracking Transparency (ATT) policy. A former official with the Competition and Markets Authority — the UK's antitrust watchdog — has filed a £2 billion ($2.7 billion) lawsuit on behalf of app developers. According to Reuters, the suit accuses Apple of placing stricter rules on external developers than its own services, thus giving the company's advertising ecosystem an edge.   ATT debuted in 2021, ostensibly to give users more control over how much of their activity app developers can track across other apps and websites. The company told Reuters it was 'bound by the exact same requirements as all developers.'   However, regulators across Europe including in France, Italy and Poland have investigated ATT. Germany's competition regulator, the Federal Cartel Office, last month determined that Apple was favoring its own apps over those from external developers. It said the ATT pop-ups Apple used for its services 'had the potential to encourage users to give their consent, whereas they had the potential to discourage consent for third-party apps.' As such, the company agreed to make some changes to how ATT works in the European Union. That follows the French Competition Authority fining Apple €150 million ($175 million at current rates) over ATT last year." #Apple #Transparency #EuropeanRegulations *This article was not written by EDSR. Are you sure your company falls outside the scope of the EU's e-Evidence Package? Many companies assume they are exempt, but the scope of the regulation is broader than expected. The EU's e-Evidence Package applies to digital service providers such as: - Cloud providers - SaaS providers - Marketplaces - Email providers - Domain registrars These companies may hold electronic evidence linked to user accounts that could be relevant in criminal investigations. Financial services companies are excluded, but many digital service providers operating in the EU, including companies based outside the EU, may still fall under the scope. Understanding whether your company is covered is the first step towards preparing for the requirements ahead. #EDPO #eEvidence #EUCompliance #DigitalRegulation #DataProtection

  • "Today, the Commission has designated ChatGPT as a Very Large Online Search Engine (VLOSE), as well as Reddit and Roblox as Very Large Online Platforms (VLOPs), under the Digital Services Act (DSA).   These services declared that they reach at least 45 million average monthly users in the EU and thus meet the threshold for designation.   Following the notification of the designations, these services have four months, i.e. by the end of December 2026, to comply with the additional DSA obligations for VLOPs and VLOSEs, such as assessing and mitigating the systemic risks stemming from their service and algorithmic systems related to the dissemination of illegal content, the negative effects on minors, users' physical and mental well-being, fundamental rights, electoral processes and public security." #ChatGPT #Reddit #DSA #VLOPS #VLOSES *This article was not written by EDSR. • "The United States just made Meta change how it treats kids. The pressure's now on for Europe to prove its tougher tech laws can do the same — or go even further.   [...]The European Commission accused Meta in July of breaching the Digital Services Act (DSA) by running addictive design features on Facebook and Instagram, and in April of failing to keep under-13s off its platforms. The EU's investigation into addictive design and minors is more than two years old but has yet to yield concessions from the company or penalties for non-compliance.   'Ironically, 9 measures out of 12 [in the U.S. settlement] are covered by the DSA, our law since 2023. U.S. courts are going faster than the EU Commission. We must ENFORCE DSA NOW!' former Commissioner Thierry Breton wrote.   [...]Thomas Regnier, spokesperson for digital policy at the European Commission, said it 'is in continuous dialogue with Meta, who still has the possibility to offer commitments in the EU.'    Meta has said it disagrees with the Commission's April and July findings. If it doesn't make changes to the EU's satisfaction, the firm risks facing a fine of up to 6 percent of its annual global revenue, which would amount to a maximum of $12 billion. Even if the full fine is imposed, which is highly unlikely, it's well under the $18 billion it settled for in the U.S." #EU #DSA #Meta #EuropeanCommission   *This article was not written by EDSR. • "Polish Deputy Prime Minister Krzysztof Gawkowski asked the European Commission to fine Meta €250 million, alleging it is failing to tackle scams and fake ads on its platforms.   Gawkowski also asked for an investigation into Facebook and Instagram's parent company in a letter to EU tech chief Henna Virkkunen dated Aug. 26 and seen by POLITICO. Gawkowski serves as Poland's digital affairs minister.   Scam ads are covered in a 2024 investigation under the Digital Services Act (DSA), but the Commission has yet to open any investigations specific to financial scams, nor has it imposed any fines on social media companies for lapses in how they protect users more broadly.   [...]   Gawkowski is asking for an investigation into breaches of six articles of the DSA, including risk assessment and mitigation, advertiser transparency and mechanisms for reporting illegal content. He is also asking Meta to take a series of mitigation measures on top of the fine." #EU #DSA #Meta #Scamads   *This article was not written by EDSR. A key deadline is approaching for companies covered by the e-Evidence Package. Starting 18 August 2026, this new EU framework will introduce rules allowing judicial and law enforcement authorities to request or preserve electronic evidence from digital service providers during criminal investigations. The package combines a Regulation setting the framework for electronic evidence requests and a Directive introducing a new requirement for certain non-EU companies: appointing a legal representative in the EU. Companies falling under its scope must appoint their representative by 18 August 2026. Starting services after this date? You’ll have a six-month window to comply. EDPO can act as your e-Evidence representative in the EU and support your organisation with this new obligation. #EDPO #eEvidence #EUCompliance #DigitalRegulation #DataProtection #RepresentativeServices
