𝗧𝗿𝘂𝘀𝘁𝘀 𝗼𝗳 𝗟𝗮𝗻𝗱 & 𝗔𝗽𝗽𝗼𝗶𝗻𝘁𝗺𝗲𝗻𝘁 𝗼𝗳 𝗧𝗿𝘂𝘀𝘁𝗲𝗲𝘀 𝗔𝗰𝘁 𝟭𝟵𝟵𝟲 𝗳𝗼𝗿 𝗣𝗿𝗼𝗽𝗲𝗿𝘁𝘆 𝗟𝗮𝘄𝘆𝗲𝗿𝘀 - 𝗨𝗻𝗿𝗮𝘃𝗲𝗹𝗹𝗶𝗻𝗴 𝘁𝗵𝗲 𝗖𝗼𝗺𝗽𝗹𝗲𝘅𝗶𝘁𝗶𝗲𝘀 At the Property Litigation Association’s ‘Great Debate’ event in 2025, the area of property law voted as most in need of reform was beneficial co-ownership of property and the law of trusts concerning the family home. Until the law is reformed, this remains a contentious and complex area of law for property practitioners at the interface of property, trusts and family. The Trusts of Land and Appointment of Trustees Act 1996 gives the courts a broad jurisdiction to make orders regulating co-ownership, and this virtual classroom seminar will address key powers under the Act. On 29 October, Sophie Gibson will lead an MBL Seminars Ltd learn live online session for property lawyers: ✅ What is the ‘common intention constructive trust’ and when does it apply? ✅ What does it mean to ’sever’ a joint tenancy and why is this important? ✅The differences between when a property is registered in one co-owner’s name and more than one name ✅ TOLATA 1996 - the remedies available to a court ✅ Orders for sale under s.14 TOLATA ✅ Procedure - how to bring a claim and whether it is a Part 7 or Part 8 matter 📅 Thursday, 29 October 🕚 11am - 12.30pm 📍 Online 🎓 1.5 CPD hours ➡️ Click here to find out more and book your place: https://lnkd.in/eJE_3jQR #Propertylaw #TOLATA #TrustsofLand #PropertyLitigation #LegalTraining #CPD #MBLSeminars

𝗛𝗶𝗴𝗵 𝗖𝗼𝘂𝗿𝘁 𝗖𝗼𝗻𝘀𝗶𝗱𝗲𝗿𝘀 𝗔𝗽𝗽𝗿𝗼𝗮𝗰𝗵 𝘁𝗼 𝗥𝗲𝘃𝗶𝗲𝘄 𝗶𝗻 𝗣𝗿𝗼𝘁𝗲𝘀𝘁 𝗜𝗻𝗷𝘂𝗻𝗰𝘁𝗶𝗼𝗻𝘀 (𝗔𝗴𝗮𝗶𝗻) On 15 October 2026, Ritchie J handed down judgment following the second annual review of the final injunctions protecting several Shell sites against unlawful protest activity. Myriam Stacey KC and Joel Semakula acted for Shell. The judgment provides guidance on the approach courts should take when reviewing the continued necessity and proportionality of injunctions against persons unknown. A central issue was what is required to justify the continuation of an injunction at an annual review, particularly where there have been no breaches of the Orders. This was the subject of what the judge called a "lively debate". Myriam Stacey KC and Joel Semakula acted for Shell, instructed by Alex Wright, Bethany Taylor and Alisha Rylatt of Eversheds Sutherland. ➡️ Click here for more information: https://lnkd.in/eqWddcsd #Propertylaw #ProtestInjunctions #HighCourt
