Responsibility built into a framework works differently than responsibility built into a message. A framework does not need to be communicated to function. It holds whether the news cycle has moved on or no one is paying attention at all. That is the difference between responsibility embedded in how a decision gets made and responsibility added after the decision is made. One requires ongoing advocacy to stay visible. The other simply operates, every time a threshold is checked. More on how that structure works, and where it leads, is at https://lnkd.in/eCMUg9vW.

The EU's overhaul of SFDR is entering a new phase, as Parliament, Council and Commission prepare to negotiate the final text. We'll be watching the human rights component with interest. Parliament's economic affairs committee has limited the exclusion to "severe" abuses that have not been effectively addressed. But who decides what is severe? And when has abuse been addressed? On 22 September, the UN Secretary-General told the General Assembly that "the power of law must prevail over the law of power". We think responsible investment is stronger when its standards rest on law, not opinion. We'll be watching with interest. https://lnkd.in/eRRWHaTc

Two capital flows, one framework. Where a rules-based exclusion applies, capital does not flow: criteria met, exclusion triggered, decision made before the fact. Where criteria are not met, capital flows as it otherwise would. No judgment call layered on top. The framework decides what to leave out. Everything else follows. https://lnkd.in/eRRWHaTc

We’re pleased to share the impact from the first six months of our support for Taawon (Welfare Association)'s NOOR program. Behind every number is a child receiving something essential: a place to learn, access to healthcare, psychological support, a warm meal or simply the stability and care every child deserves. In just six months, NOOR has reached 250 orphaned children in Gaza with support designed not only to meet immediate needs, but to help them learn, heal and look toward the future. Seeing this work up close, and witnessing the care and dedication behind it, has been deeply inspiring. Through The Justice Company Humanitarian Foundation, we’re honored to support Taawon and the extraordinary impact NOOR is having on young lives. #TheJusticeCompany #HumanitarianAid #NOOR #Taawon

When does a company's connection to a human rights concern become grounds for excluding it from an investment portfolio? It's a question that doesn't always have a straightforward answer. Our Senior Adviser, Mike Head, explores this challenge in the latest episode of FT Adviser's Margin Notes podcast with Simoney Kyriakou. Drawing on examples from The Justice Company's human rights screening work, Mike discusses the complexities of assessing companies' links to potential human rights abuses, as well as the gaps in ESG frameworks when it comes to human rights. Investor resilience rests on two things: information about markets and risk, and structural clarity about how a framework is built before capital moves through it. A rules-based exclusion framework is legible by design. Criteria published, fixed, applied the same way regardless of market conditions. World Investor Week is a reminder to look at both. https://lnkd.in/eRRWHaTc

Crimes against humanity. Apartheid. Both are legal terms, defined under international law through instruments including the Rome Statute, not political labels applied at discretion. Crimes against humanity describes specific acts committed as part of a widespread or systematic attack on a civilian population. Apartheid describes a system of institutionalized racial segregation and discrimination enacted to maintain domination by one group over another. An exclusion framework built on these terms is built on law, not opinion. https://lnkd.in/eRRWHaTc

Rules-based exclusion means the criteria are fixed before any company is evaluated, then applied the same way across the board. They do not shift with sentiment, headlines, or which sector is under scrutiny this quarter. A scoring model can move a rating depending on who is weighting it. A rule cannot. It applies, or it does not. That is a structural difference, not a matter of degree. https://lnkd.in/eRRWHaTc
