Todd & Weld attorneys Tyler Chapman and Matt Furman successfully represented the trustees of a condominium in an appeal involving an easement dispute between abutting Cambridge properties. On September 25, 2026, the Massachusetts Appeals Court vacated the Superior Court’s judgment dismissing the trustees’ claim to reform a 1997 recorded easement based on mutual mistake and remanded the case for further proceedings. The Superior Court had concluded that the trustees’ claim was barred by the statute of limitations because the easement’s recording in 1997 provided constructive notice of the alleged mistake. The Appeals Court disagreed, holding that recording the easement did not, by itself, cause the reformation claim to accrue. Rather, the limitations period begins when the mutual mistake was, or should have been, discovered because a reason to examine the recorded instrument arose. 🔗Read more: https://lnkd.in/g9k6ksrh #ToddWeld #RealEstateLitigation #AppellateLitigation

Todd & Weld attorney Jacob Maddox filed an amicus curiae brief on behalf of the Massachusetts Association of Criminal Defense Lawyers (MACDL) in support of plaintiffs in Massachusetts Association of Private Appointed Counsel, Inc. (MAPAC), et al. v. Attorney General of the Commonwealth of Massachusetts. The brief presents survey evidence from 92 Massachusetts attorneys who accept or have accepted court-appointed criminal-defense assignments. Among respondents, 97% reported that they could not clearly determine what conduct would comply with G.L. c. 211D, § 11(a)(2), while 55% reported being less willing to accept new appointed cases.
