When Commercial Cases Are Decided at Summary Judgment Cases are more likely to be resolved at summary judgment when there is no genuine dispute over material facts. Robert Arnett explains happens in straightforward commercial disputes like promissory notes, debt collection, or lease non-payment cases. When the key facts are documented and undisputed, courts can decide the case as a matter of law without a trial. “Sign it. Otherwise this matter will never end.” People sometimes sign agreements, settlements, undertakings or property papers simply because they are tired, frightened or under pressure to “finish the matter”. But a signature can have consequences far beyond that moment. Whether a document can later be challenged depends on what was signed, how it was executed and the circumstances surrounding it. Consent obtained through legally recognised forms of coercion, fraud or undue influence can raise serious questions. Don't sign an important document just because someone is making you afraid of what will happen if you don't. #LegalAwareness #Settlement #Agreement #CivilDispute #PropertyDispute #ContractLaw #KnowYourRights #CivilLitigation #IndianLaw #TalukdarFoxwheelLaw

TL;DR: Pre-suit settlement offers arrive when the debtor's exposure is highest and the creditor's leverage is clearest. The decision to accept or litigate turns on recovery timeline, enforcement risk, and whether the offer reflects the full claim or strategic delay. #confessionofjudgment #creditorlitigation #enforcementrisk #floridadebtcollection #postjudgmentcollection #presuitsettlement #settlementagreement

Owed money doesn’t automatically mean IBC is the answer. The Insolvency and Bankruptcy Code is primarily designed for insolvency resolution and revival, not as a substitute for ordinary debt-recovery proceedings. The Supreme Court has reiterated this distinction. Before initiating proceedings, understanding the nature of the debt, default and the appropriate legal remedy is crucial. Have you seen IBC being treated as a recovery route? Share your thoughts below. #IBC #InsolvencyLaw #NCLT #CorporateLaw #LegalAwareness #IndianLaw #Jurionex

Dividing assets in a separation through litigation can take years, largely because both sides are arguing in front of a third party who has to be convinced of every detail, property values, income, contributions, before anything gets decided. In mediation, both people already know the details of their own finances. The work is agreeing on a division that is fair to both, with a mediator helping structure the conversation and keep it productive. That difference alone often cuts the timeline from years to weeks or months, and avoids the legal costs that can quietly consume a meaningful share of the assets being divided in the first place. If a financial settlement is the piece holding up your separation, it is worth exploring mediation before a long court process. info@settlewisenow.in #divorcesettlement #familymediation #ADR #mediation #SettleWiseNow

Clients budget for the arbitration. Almost none budget for enforcement. Then the award arrives, and the losing party's assets are elsewhere, held by someone else, inside a structure built years ago. After 34 years in practice, the pattern is familiar: the dispute is won in the hearing room and lost in the contract. Three mistakes, all made before any dispute exists: 1. The clause is drafted for the tribunal, not the enforcement court. Seat, law and institution get attention. Where the assets sit gets none. 2. No security. No parent guarantee, no standby letter of credit, no escrow. The award runs against a subsidiary with nothing in it. 3. Asset mapping starts after the award. By then the money has moved. Also: recognition under the New York Convention is one step. Execution is another. Immunity from execution is a different question from immunity from jurisdiction, and it is what stops awards against state entities. So the test for any international contract is not "is the arbitration clause enforceable?" It is: "If we win, where exactly do we collect, and from what?" If your lawyer cannot answer that before you sign, you have a clause, not a remedy. What is the worst enforcement obstacle you have faced? #InternationalArbitration #Enforcement #GeneralCounsel

The case reinforces an important litigation lesson: Cross-examination is not a procedural formality. One material admission can connect the documents, the transaction and the law — and alter the course of a case. A dishonoured cheque may trigger a statutory presumption. But the ultimate question remains whether a legally enforceable debt or liability existed when the cheque was presented.

A federal judge applied the century-old Robins Dry Dock rule to dismiss business-interruption claims from companies that suffered financial losses but no physical property damage from the Key Bridge collapse. The court rejected an exception for alleged criminal or intentional conduct, and claimants have appealed to the Fourth Circuit. The case may test whether courts, the Supreme Court, or Congress will change the rule.

A funding deal that eliminates the funder's risk isn't an investment. It's a loan, and in New York that can mean losing repayment entirely. Sharp analysis from Reid Skibell, Joseph Gallagher, and Colleen Piasentin in Bloomberg Law on how Denemark draws that line.
In New York, a litigation funding deal with too little risk can cost the funder everything, including principal. A recent First Department ruling holds that when a funder has recourse beyond the client’s recovery, the arrangement is a loan subject to usury law, and repayment can be voided. New York’s new Consumer Litigation Funding Act draws the same line for consumer funding. In Bloomberg Law, Glenn Agre partners Reid Skibell and Joseph Gallagher and associate Colleen Piasentin explain what this means for funders. Their key points: · Layering on risk-reducing clauses can backfire. Courts examine whether the funder’s risk is real. · Precautionary drafting won’t save a riskless deal. The court disregarded a clause capping interest at the highest lawful rate. · Pricing below the usury threshold can protect principal even if the deal is treated as a loan.
