O’Melveny Antitrust partner Philip Monaghan recently participated in a panel discussion at GCR Live: China 2026. The session, “Cross-border M&A in an era of regulatory fragmentation,” examined rising regulatory scrutiny, national security-driven deal risk, and compliance challenges under competing EU and Chinese laws. Philip was joined by Yung Yung Janet Hui, Xiaoxi Cheng, Heng Ju, and Edwin Li. O’Melveny was proud to support Global Competition Review (GCR) Live: China 2026. #OMMAntitrust #OMelvenyShanghai

Hogan Lovells Cadwalader International Trade partner Joshua Kurland will moderate "Next Generation Trade Enforcement: Tools and Trends" at the 23rd Judicial Conference of the U.S. Court of International Trade on October 20. International trade enforcement is entering a transformative era, shaped by expanded authorities, new analytical tools, and evolving priorities that are influencing how agencies and industry approach compliance. This panel will explore the tools government authorities and private actors are bringing to bear, how companies and counsel are adapting their compliance strategies, and how this rapidly evolving landscape is reshaping the work of trade practitioners, the courts, and in-house counsel. For companies operating across global markets, understanding these developments is increasingly critical to managing legal and compliance risk.

"Are we watching the regulatory pendulum swing toward less intrusion?" Deregulation, simplification, recalibrated enforcement: the regulatory landscape is shifting on several countries & continents at once and not always in the same direction. On Wednesday (7 October) at the 2026 IBA Annual Conference in Copenhagen, I will have the honour of moderating a Corporate Counsel Forum (#CCF) panel on recent political and regulatory developments and what they mean in practice for #CorporateGovernance, #RiskManagement and the work of #GeneralCounsel and in-house legal teams. At a time when the ability to read and anticipate legal change has become a competitive advantage and a core part of business strategy, we will discuss: 🔹 Whether the pendulum is really swinging or just being recalibrated jurisdiction by jurisdiction 🔹 EU simplification and the AI Act timeline, national gold-plating and the rise of litigation and collective redress 🔹 Enforcement priorities, tariffs and export controls and economic security in North America and Asia-Pacific 🔹 Why directors duties dont follow the pendulum and how boards should respond 🔹 The in-house response: a global baseline or local calibration, scenario planning and what GCs should ask their advisers I am delighted to share the stage with an outstanding international panel: Caroline Berube, Dr. Gabriele Haas, Masako Takahata, Sam Hosseini and Suzanne Kröner - Rosmalen If you are in Copenhagen, please join us: the discussion will be interactive and - at the end of the session - Robert Strang will present the work of the CEELI Institute in the fields of the #ruleoflaw. #IBA2026 #IBACopenhagen International Bar Association

It was enlightening to have such a meaningful Hinrich Foundation Trade Book Talk conversation with Dr. Olawuyi. One clear takeaway for me is we see the importance of global trade from a humanitarian perspective once trade is restricted in cases such as an embargo. Looking forward to more conversations with Damilola!
In this comprehensive Hinrich Foundation Trade Book Talks session, I sat with Alexander Boome, to discuss our latest book, Trade Restrictions, Sustainable Development, and the Law: International and Regional Perspectives (Routledge), co-edited with Dr. Ahmed Essa Alsulaiti. The conversation examines how unilateral trade tariffs, blockades, sanctions, and embargoes disrupt the economic, social, and environmental pillars of sustainable development; evaluates the institutional limitations of current dispute settlement bodies; and outlines practical frameworks for nations to build trade resilience and reinstate multilateral cooperation. The 3Ps (Prevention, Preparation and Protection) discussed can guide current and future efforts to build trade resilience. Global trade restrictions have surged by more than 400% since 2015, according to the IMF. Asia is at the very centre of this supply-chain realignment. This has pushed legal leaders far beyond compliance. They are now proactively mapping geopolitical frictions, de-risking trade routes and guiding business strategy through unprecedented volatility. Join more than 300 GCs and chief legal officers at the 2nd annual General Counsel Summit Asia to explore the legal realities of global disorder. 📅 October 15th 2026 | Singapore 📍 Economist Enterprise | General Counsel Summit Asia 🔗 https://brnw.ch/21x6hgB #Geopolitics #TradePolicy #EconGCAsia

Beijing wants industry associations to rein in price wars at home. Abroad, the same talk among rivals over prices, costs and output can count as a cartel. Revised SAMR guidelines on overseas anti-monopoly compliance, open for comment until 29 September, now spell out where that line sits. Some key industries and firms already face investigations or lawsuits abroad as ‘involution-style’ competition spreads, the drafting notes concede, without naming them. The draft turns a broad 2021 text into a working toolkit, with appendices running from dawn-raid procedures to merger filing thresholds. Its warnings are blunt. Swapping sensitive information can breach EU law on its own, and merely receiving it may be no defence. US enforcers can detain staff at the border in criminal cartel cases. Associations may still issue guidance, run training and put firms’ views to foreign regulators, but must keep away from sensitive data. One case cited is a German steel cartel, in which two associations hosted meetings and pooled pricing data for ten firms, contributing to fines of about €355 million. Europe dominates the risk map. Eight of 15 new case studies come from the EU or its member states and two more from the UK, and EU foreign subsidy checks join firms’ self-assessment list. The approach grows out of a solar-sector trial, where early warnings helped firms correct course before coordination at home turned into exposure abroad. The draft also lets firms challenge foreign probes as improper extraterritorial jurisdiction under April 2026 regulations, a route that sits uneasily beside its own warnings against obstructing enforcers. source: https://buff.ly/Tr7udjQ #China #Antitrust #CompetitionLaw #AntiMonopoly #SAMR #PriceWars #Cartel #EUCompetitionLaw #USAntitrust #OverseasCompliance #ChinaPolicy #TradeCompliance #BusinessCompliance #IndustrialPolicy #ForeignSubsidies #MarketRegulation #GlobalCompetition #ChinaEconomy #Involution #PolicyCN

Love to see East Asian jurisdictions find a more aligned voice, grounded in their own market and institutional contexts. https://lnkd.in/gXCHaARi If I'm not mistaken, Taiwan’s competition law also encompasses rules on unfair trade practices (Arts 20, 25; See Niou 2026, https://lnkd.in/gvbzTUZH), not to mention Korea and Japan. And the market dynamics here are quite different from elsewhere, eg the EEA. I believe that in this region, the nexus between innovation and competition deserves even greater weight. I have no answer on protectionism, industrial policy, or their net contribution to growth (it could go either way), but am certain that legislative, pre-defined regulations (designed by politicians or regulating beauracrats) almost always end up producing unintended distortions. (In my ongoing working paper, for ASCOLA, I explore the cultural field status in competition law, arguing that these jurisdictions should not remain on the periphery (passively absorbing the "consensus" forged in the transnational competition policy-making field), but actively shape and contest global discourse.)
