In Algeria, “strategic sectors” has a defined legal scope: defence, rail, ports and airports, and pharmaceuticals. Since decree 25-304 (November 2025), a transfer of shares to a foreign investor in these sectors needs the supervising ministry’s prior authorisation, with a decision due within 60 days. Under Law 22-18, investor-State disputes go to Algerian courts unless a treaty or an agreement with the investment agency provides otherwise.
