🔐 Designing For Privacy UX. Privacy isn’t about hiding something, but protecting user’s personal space. UX guidelines on how to design more respectful, private experiences that drive long-term loyalty ↓ 🤔 When data requests feel intrusive, users enter fake data or give in. ✅ Privacy is about user’s control of what happens to their data. ✅ Privacy by default: features should work with min data required. 🚫 Don’t ask for permissions that you don’t need at the moment. ✅ Right to be forgotten → allow users to delete data in settings. ✅ Data portability → allow users to take their data with them. ✅ Hidden Unsub links downgrade email reach (marked as spam). ✅ Neutral choices → give people real choices with neutral defaults. ✅ Data you don't ask for is the data you can't lose in a breach. ✅ Explain then ask → if you need user’s data, first explain why. ✅ Try before commit → show and explain value before asking for data. ✅ Remind me later → give people time to make a decision on their terms. ✅ Contextual consent → ask for data only when user’s action needs it. ✅ Automated data decay → delete user's data not used after X months. --- In many companies, privacy is treated as a technical hurdle to be cleared off. Companies thrive on user’s data for personalization, customized offers, better AI models — but also invasive targeting, ultra-precise tracking, behavioral predictions and eventually reselling data to the highest bidder. All of it isn’t only invasive and undermines trust — it also makes for slow experiences and advertising following you everywhere you go. Predictive models know a person is pregnant based on their browsing habits before they do. And once they do, ads, offers and messages will follow you everywhere you go — before your closest relatives hear it from you. When we speak about privacy, we often assume that that’s an exaggerated problem that doesn’t really affect us much. After all, we have nothing to hide, and so there is no harm in companies knowing a few things about us. But privacy isn’t about hiding something. It’s about protecting your personal space from external influence and manipulation. It’s about protecting your personal decisions and your intimate experiences, and having a choice to share them with people you trust and care of. Most people wouldn’t feel comfortable being observed by a camera during their work or during their spare time. Yet as we move from one page to the next, that’s exactly what happens, often without our consent. And just like web performance and accessibility, privacy is a part of user's experience. The good news is that European Commission is looking into modifying the way GDPR works. So users could tick a box in browser preferences, with privacy settings turned on by default. And then websites shouldn't be allowed to ask for consent because it's already not granted. I'm looking forward to that future. 🇫🇷 CNIL just published guidance on informing data subject in the context of AI + GDPR (Jan. 5, 2026). 🤖 A few quick takeaways: ✅ 1) The scope is broad. CNIL frames transparency as applying whether data is collected directly (first-party) or indirectly (downloads, web scraping tools, APIs, partners, data brokers, reuse of existing datasets). It also flags that this includes data generated by the controller, citing a CJEU decision. ✅ 2) Timing: If data is not collected directly, CNIL reiterates the expectation to inform data subjects as soon as possible and within one month of retrieving the data (or earlier at first contact / first disclosure to a recipient, as applicable). Also notable: CNIL encourages a reasonable time gap between notice and model training when data is particularly sensitive, so rights can be exercised before training (given the technical complexity of “fixing” things at the model layer). ✅ 3) CNIL is explicit that AI complexity is not an excuse: information should be clear, intelligible, and easily accessible, and can use diagrams explaining how data is used in training, how the AI system works, and the distinction between the training dataset, the model, and outputs. ✅ 4) CNIL notes the GDPR derogation where individual notice is impractical or would require disproportionate effort, but stresses case-by-case analysis and documenting the balancing of (i) privacy impact and (ii) burden/cost and lack of contact details, plus safeguards (e.g., pseudonymization, DPIA, reduced retention, security measures). https://lnkd.in/gvmfbJyi #GDPR #Privacy #AI #AIGovernance #CNIL #Compliance #DataProtection #LLM

Meta paid $𝟭.𝟯 𝗯𝗶𝗹𝗹𝗶𝗼𝗻 for privacy violations Amazon faced a $𝟳𝟴𝟭 𝗺𝗶𝗹𝗹𝗶𝗼𝗻 fine Facebook paid $𝟮𝟳𝟱 𝗺𝗶𝗹𝗹𝗶𝗼𝗻 Google? $𝟭𝟲𝟵 𝗺𝗶𝗹𝗹𝗶𝗼𝗻 settlement All for crossing the privacy line. Your Startup can loose everything because: → Users found out their data was oversold → Trust was broken by hidden tracking → Personalization went too far As a product designer and business owner, here's where I draw the line: The Privacy-First Framework I use: → Give users control to opt out easily → Only collect what you'll actually use → Make data collection obvious, not hidden → Delete data when you don't need it anymore Ask yourself: "Would I be comfortable explaining our data practices to my users face-to-face?" If the answer is no, you've crossed the line. Quick ethical guidelines: → Show users what you know about them → Be transparent about data sharing → Let them delete their data easily → Make 'Off' the default setting Because here's the truth: Users will forgive a bad design But they never forget a privacy breach Whether you're a designer or business owner/decision maker, you should have this talk with other stakeholders. Transparency is of particular relevance in situations where the technological complexity of practice makes it difficult for the individual to know and understand whether, by whom and for what purpose personal data relating to them are being used, such as in the case of AI models. *** EDPB's Opinion 28/2024 on certain data protection aspects related to the processing of personal data in the context of AI models Transparency measures: in some cases, mitigating measures could include measures that provide for greater transparency with regard to the development of the AI model. Some measures, in addition to compliance with the GDPR obligations, may help overcoming the information asymmetry and allow data subjects to get a better understanding of the processing involved in the development phase: a. Release of public and easily accessible communications which go beyond the information required under Article 13 or 14 GDPR, for instance by providing additional details about the collection criteria and all datasets used, taking into account special protection for children and vulnerable persons. b. Alternative forms of informing data subjects, for instance: media campaigns with different media outlets to inform data subjects, information campaign by e-mail, use of graphic visualisation, frequently asked questions, transparency labels and model cards the systematisation of which could structure the presentation of information on AI models, and annual transparency reports on a voluntary basis. *** -Model cards are short documents accompanying trained machine learning models that provide a benchmarked evaluation in a variety of conditions, such as across different cultural, demographic, or phe- genotypic groups (e.g., race, geographic location, sex, etc,.) and intersectional groups (e.g., age and race, or sex) that are relevant to the intended application domains. -Model cards serve to disclose information about a trained machine learning model. This includes how it was built, what assumptions were made during its development, what type of model behavior different cultural, demographic, or phenotypic population groups may experience, and an evaluation of how well the model performs with respect to those groups. -Model cards provide a way to inform users about what machine learning systems can and cannot do, the types of errors they make, and additional steps that could create more fair and inclusive outcomes with the technology. *** Example: A social media platform provides an AI system card to its users to explain how its AI uses user activity data to generate recommendations for its content feed. The system card contains a step-by-step walkthrough on how the AI system gathers user activity data and broadly processes it in its AI system with other parameters to generate personalized output for a content feed. Everyone is excited, the KPIs look great, and users are relying on it for key business decisions. But soon, questions start popping up. "Why don’t these numbers match what we saw last quarter?" "Are these KPIs based on solid data?" The data team assures them that the numbers are correct—but they know the reality. Behind the scenes, data quality isn’t always perfect, and sometimes they’re forced to deliver results based on optimistic estimates. The trust gap begins to grow. This is where the Trust-Tiered Interfaces pattern comes into play. 💡 With this approach, instead of delivering one opaque interface, the product offers users three clear choices: - High Confidence Interface 🔒: Where users get only the rock-solid, validated data—perfect for making high-stakes decisions with confidence. - Optimistic Interface 🌟: Optional, but more comprehensive, where corrected data is included. It gives a broader view, while still based on accurate info. - Data Quality Interface 🔍: Here's the game-changer—an interface that shows exactly how reliable the data is. It’s fully transparent about the sources, gaps, and uncertainties, so users know what they’re dealing with. Before this, most teams offered either the high confidence or optimistic view without giving users insight into data quality. But hiding those imperfections was a loophole—one that quietly allowed issues to slip from one data product to another. 🔑 Here’s the truth: Data will never be perfect, and that’s okay! The key is being upfront about it. By offering the Trust-Tiered Interfaces, data teams can empower users to understand the quality of the data they’re working with. 🔒 Privacy by Design: Build Trust and Innovation into Every Line of Code As software engineers, architects, and developers, we’re not just writing code—we’re shaping the future of digital trust. Privacy by Design (PbD) isn’t a checkbox for compliance; it’s a philosophy that enables us to build privacy-first systems that are secure, scalable, and user-friendly from the ground up. Let’s break down the seven foundational principles of PbD and what they mean for us in practical, code-level terms: 1️⃣ Proactive, Not Reactive Identify privacy and security risks during the design phase—before the first line of code is written. Example: When designing a form, anticipate risks of exposing sensitive data. Use input validation to prevent injection attacks and ensure fields for personally identifiable information (PII) are encrypted by default. 2️⃣ Privacy as the Default Setting Users shouldn’t need to change settings to be protected. Make privacy the baseline. Example: When building a social network, set new accounts to private by default, allowing users to opt-in to public visibility. Limit data collection to the minimum needed—use "data minimization" principles. 3️⃣ Privacy Embedded into Design Privacy features must be integral to the system, not add-ons. Example: In a logging framework, mask or hash sensitive data like user emails before sending logs to external systems. Use privacy-preserving analytics that aggregate or anonymize data rather than tracking individual user actions. 4️⃣ Full Functionality—Positive-Sum, Not Zero-Sum Don’t compromise usability for privacy—find win-win solutions. Example: Instead of asking users to toggle privacy settings for every feature, implement context-aware privacy notices that explain privacy implications in real-time, improving transparency without cluttering the UI. 5️⃣ End-to-End Security—Lifecycle Protection Secure data from collection to destruction. Example: Encrypt sensitive data in transit and at rest using strong algorithms (e.g., AES-256). Implement automatic data expiration policies for temporary data, such as session cookies or cache files, to prevent long-term risk. 6️⃣ Visibility and Transparency Make privacy controls visible, and document your practices clearly. Example: Provide a privacy dashboard where users can manage their data preferences, download their data, or request deletion. Use audit logs to track access to sensitive data for internal visibility. 7️⃣ Respect for User Privacy Design with user-centric privacy choices. Example: Build clear and concise consent flows. Instead of a 10-page terms-of-service, use just-in-time notices explaining what data is being collected and why—empowering users with meaningful control. How I advise clients to evaluate and implement transparent AI: Last week I posted about the lack of actionable guidance for AI-related "transparency," so came up with some of my own that I share with StackAware clients. 1. Training/processing data disclosures -> Inventory all data sources used in model training, prompt engineering, or retrieval-augmented generation (RAG), including origin, collection methods, and licensing status. -> Provide dataset versioning and changelogs to track modifications over time. -> Clearly label synthetic / AI-generated data. 2. Development process documentation -> Maintain timestamped records of model iterations, including hyperparameters, architecture changes, and retraining / fine-tuning events. -> Publish a summary of key design choices explaining why specific algorithms, features, and optimizations were used. -> Disclose strategies used to mitigate undesired or unlawful biases. 3. Operational and governance transparency -> Maintain an AI asset inventory listing all deployed systems and intended uses. -> Publish which single person is accountable for each system’s oversight, updates, and error handling. -> Disclose all third-party components or services integrated into the system, preferably via a software bill of materials (SBOM). 4. Stakeholder communication -> Create a plain-language AI system overview explaining its purpose, data sources, and governance model. -> Provide user-accessible documentation on how AI-generated outputs are reviewed, corrected, or overridden when necessary. -> Document and communicate specific inputs which lead to unreliable outputs from the AI system (e.g., edge cases, known failure modes). 5. Logging, traceability, and feedback -> Maintain logs of all AI-generated outputs, including the inputs used, the confidence score assigned, and any post-processing applied. -> Ensure all logs are exportable and machine-readable for external audit and compliance purposes. -> Implement a mechanism for users to report errors, document transparency concerns, and request human review of AI outputs.
