Chilean holidays are only established by presidential decree and can only be changed in the same manner. The current holidays were established in 1915 under Presidential Decree 2977.

Since this initial decree, different presidents have added and removed some of the holidays. Each year, the Minister of Labor will announce the official holidays of Chile for the following year based on these presidential decrees.

Under Chilean labour code, employer must provide employees a day off for a nationally recognised holiday. Chilean law also stipulates that if the employee cannot take the day off due to the nature of the work, they must be compensated with extra pay or a substitute paid day off.
