What is going on in Springfield? A Tanning Facility Permit Fund?
Am I reading this correctly and seeing that even though we have a huge crisis in this state with DCFS that the democrats have decided to cut training funding to the tune of over $1,000,000?
Good Samaritan Energy Trust Fund......................$7,191
Looks like I'll be losing my cush job of walking little old ladies across streets in exchange for the state paying my gas bill.
I cannot believe that some of these funds exist! Now I know what people mean by waste in state government. I guess when economic times were good you could get money from the state for anything. Now, we need to take it away.
Dear Rich,
I have questions and hope you can help find the answers. I may misunderstand the fund-sweeping concept...
Does sweeping the funds in any way compromise a claimant's ability to recover in a lapsed appropriation (or other type) case filed with the Court of Claims? Payments for lapsed approp claims require that the corresponding funds have enough in their balances to cover the claims. If the balances are swept, do claimants then have to wait for the Court of Claims' special appropriations bill?
And, do any of these swept funds lose matching funds for the state bec/of the sweeping?
Thanks so much!
The above is why the budget is a non issue for 99% of the voters.
That is such mind numbing detail! Even a guy like me, very interested in such things can hardly make sense of it.
I appreciate it being posted, but let's face it, you need to be a darn good communicator to make an issue out of that!
Several of these "funds" listed come from federal money like the DNR Open Space Land Acquisition and the State Police DUI Funds and Hireback.....how can you use federal funds to balance a state budget? I think we should have Holland do an audit.
Pat Collins:
Here's the story: often, when a state agency purchases goods or services, the funding is obligated from a specific line item (i.e. DNR might buy a truck and plan to pay from the used tire fund). If the bill isn't submitted within the lapse-spending period (60 days after the close of the fiscal year), the vendor has to go to the Court of Claims.
A process takes place, and if funds from the specified fund remained at the end of the fiscal year (there was still a balance in the used tire fund, i.e.), then the Court can award payment.
If there's isn't a balance, the vendor has to get added to the special approp bill that passes with the budget. That means the vendor has to wait up to a year.
Sorry if it sounds mind-numbing, but it's the way your state government operates and it happens all the time that vendors are trying to get paid via the Court of Claims process.
Thanks!
It IS mindnumbing, but I guess rapid submission of invoices is VERY important if you do biz with the state.
Now, I can see vendors submitting bills on time, but them waiting in the "in basket" when money is tight.....
Pat Collins:
There are vendors who won't do business with the state bec/it takes so long to get paid, even when bills are submitted on time. Hotels refuse to "direct bill" the state bec/of the delay -- landlords, who haven't had leases renewed (so they're in "holdover" status) don't want to make improvements bec/they don't have a solid lease and they get lease payments really late...it's bad for small business owners. I've talked with court reporting services that say they can't make payroll while they're waiting...
In some cases, raiding these funds will shift burdens to county or local govts as well.
AND the courts are still deciding if it's even constitutional...
To start off, I never thought this idea of sweeping the funds was right, or even legal. Have the courts definitively decided this or what?
Second, as I waded thru the list and noted the amounts, my shock and indignation grew by leaps and bounds... the amounts being swept from health and safey and general welfare programs boggles the mind, many, like sweeping DCFS and state police funds, just make absolutely no sense, they are in direct opposition to the administration's own stated policy initiatives. They are eating their own young. How can you spend all that time plugging Amber Alert, then pull funding for the statewide police computer network used to find the kids!?!?
Other sweeps, relating to the quality of Illinois living, and the protection and stewardship of resources, well, let's just say that the Land of Lincoln is now on the fast track to looking like the worst parts of New Jersey. Decades of painstaking, incremental environmental progress will be halted, even reversed, by these sweeps.
If the absolute worst of the neoconservative global-market republican greedheads were trying, for a year, they could not have done more damage than my own party has done to the state this week. I truly am outraged and ashamed to be a democrat today. The people that backed this budget plan will not be around to share our misery when the real bills come due, when the results of these sweeps start becoming our daily headlines, no, they will have gone on to a lovely retirement in some state with clean air and water, with law and order, with adequate and well-managed public services.
I am disgusted by the governor AND the legislature, they are cowards, all, trading all our futures for their momentary job security. Oh, am I going to be busy come the next elections!

Actually, the Open Space Land Acquisition Fund (OSLAD) has not been included on the sweep list. GRod tried this last year (same time, same tune) and was soundly thrashed by an odd coalition of Senate Dems and Rs, House Dems and Rs, local government people, tree-huggers, and so forth.
OSLAD was on the list for a while earlier this spring but the same coalition got it steered off the list.
The list is amazing though. I know for a fact that for some of those funds, grants from the State have already been made and now that the fund balances (there to pay the grants already made) are being swept, how will the State pay the grants it has made?
Upon reading the list of funds, and reading the title and description of the section outlining some of the sweeps such as this one;
"Sec. 8.44. Special fund transfers.
(a) In order to maintain the integrity of special funds and
improve stability in the General Revenue Fund, the following
transfers are authorized from the designated funds into the
General Revenue Fund:"
How does taking the money from the special funds "maintain the integrity of special funds..." as it is stated?
This has me confused.
It is my understanding that only surplus amounts from these funds were swept. I think that surplus has been defined as anything above two or three month operating expenses. It is also my understanding that if an emergency should arise, and money from one of these funds would be needed immediately, a fund has been established to loan that money back to the swept fund.
Therefore, why the cries of robbery? Operations of these special groups will noot be affected -- if there is an emergency, they will have fiscal backup. On the other hand, with all of this surplus money sitting there in these funds that dont benefit 99% of the people in this state, why shouldnt that money be used to help fill budget holes in difficult times?
I, for one, feel that there are far too many of these special funds -- the fact that so many exist causes me great concern that money in this state isnt being spent for the greater good. No other state has so many funds -- they should be done away with, or at least used in times of fiscal crisis for the good of all of the state.
I believe the courts ruled that the sweep was unconstitutional (when Community Bankers sued) and that it's on appeal.
For the last anonymous: the legislature is the only branch of govt authorized to appropriate funds. When funds get appropriated for one purpose (whether you like the number of special ones or not), they are supposed to be used for that purpose. The Gov (Executive branch) is sweeping funds for purposes for which they were not appropriated and that's the problem, legally.
Please know: there are no surpluses for operating state govt these days. Agencies are running on empty, top-heavy with inept, yet arrogant Gov appointees.
Sweeping the funds amounts to the Exec branch usurping the authority of the legislative branch, shifts the obligations for many programs to county or local govt (you still pay for that), and possibly compromises matching funding.
Stella you are good girl! To anoy 12:40 even though money can be transferred back to the special funds to meet obligations at the end of the day (06/30/06) the special fund has to come up with the transfer amount.
This admin. is telling State Agencies if you don't spend it we will! Long term planning has become a non-issue.
Clearly Anonymous who purports to think there are too many special funds doesn't know the first thing about them. He/she says "why cry robbery when they are surpluses" I'll tell you why...because many of those funds work with community grants which take awhile to realize, and in many cases, the funds are reimbursed to communities when the work is done, not up front...THEREFORE, it may look like a surpluse, but in fact they are keeping an obligated balance toward future invoices...weep the funds and you set off a terrible chain reaction. Once again, this administration has proved it has not the accumen to govern, only the will to deceive.
What's not mentioned so far is that a number of these special funds (if not most) get their revenue from special taxes or fees, not the general income tax.
Your motel bed tax goes toward the Tourism Promotion Fund to help advertise the state (attract more tourists who will spend money) or for tourism attraction development in the case of the Tourism Attraction Program.
One of the problems with these sweeps is that it breaks the promise made by the legislature when they created whatever tax or fee, that the money would be spent on whatever the lawmakers promised in the first place.
I may be wrong, but I think the Illinois Historic Sites Fund is funded through donations made by visitors to state's historic sites. Those donations were given with the loose understanding that they would go operate and improve the state's historic site system, not to the governor's office.
Likewise, some of those DNR-related funds come from campground fees, as well as federal funds, as another poster mentioned. Raiding these funds isn't ethical and definitely when federal money is involved, I'm not certain it's even legal.
State government has to serve numerous functions. It cannot just stop serving some functions in off years and come back later. If there is no money, fine, then fix the problem.
Either formally get out of the business of whatever constituency its trying to serve and let another model be organized, or raise taxes, which would only further hamper the state's ability to attract investment for new jobs and new revenue.
Radiation Protection Fund to protect the Tanning Facility Permit Fund.
FYI, the radiation protection fund goes towards cleaning up problems such as PA experienced with 3 Mile Island. We had all better hope that some airline isn't commandeered to hit a containment building at Zion, Byron, Quad Cities, etc. It would take much more than $212+K to take care of the radiation problems. Luckily for us downstaters, the plume flows west to east, right over Lake Michigan.
Also, has anyone any idea of the cost of processing the $7.00 and $13.00 sweep from two of the agencies on the list? Probably will cost us $75 - $150 to collect $$20. Sounds like good fiscal policy to me:-(
J. Musgrave -- you've touched on something that needs to be articulated and considered (and will be by the judicial branch of govt) and which lies at the heart of the separation of powers questions that arise when we examine the funds-sweeping ... the promises made by the creation of these funds by the legistative branch of govt (which represents the electorate on a grassroots basis) is being usurped by the exec branch.
You must also remember that part of the Filan regime has also allowed the administration to take 75% (yes, 75%) of the fund balance as of June 30th. As anyone who understands governmental finances, this is absurb. In addition to that 75% balance, these other robberies take place. It completely undermines these funds and their balances. It is a back-door cut to operations that provide services to the State. They won't make the tough decisions and instead are going to leave the State in the worst fiscal crisis it has seen.
"What is going on in Springfield? A Tanning Facility Permit Fund?"
Yup. If we can all agree that tanning facilities should be licensed by the state in some way - in this case it looks like there's a permit - then when places pay those fees to the state, that money has to go into a fund.
>then when places pay those fees to the state, that money has to go into a fund.
Which then isn't necessarily used for the tanning industry.
If someone said the tanning industry should not be regulated, I would have to agree. 'Regulation' seems to be just another way to get money in the general fund so you can pay off your cronies.
Sorry for the cynicism but you have to call them like you see them.
The Illinois Underground Utility Facilities Damage Prevention Fund comes from a tax on motor fuel, with the logic being that most storage tanks are at gas stations.
Last year, I believe, $10-12 million was diverted from this fund for general fund purposes.
That's minor compared to the MFT diversion from IDOT, I suppose, but still disturbing for those who think taxes should go where they were promised to go.
Is the solution here to make these funds less accessible to funding sweeps? That is, require some kind of specific legislative debate before the fund is swept. It would take up more legislator time but they aren't overworked. And, without a debate, it's very difficult for the average Illinoisian to understand the pros and cons of 1) having these funds and 2) sweeping them.
As to DCFS, could it be that the reduced need in training funds is connected to the huge drop in foster care numbers over the past decade. If you don't need as many workers, you don't need to train as many workers, so training costs do and should go down etc etc. I am not aware of a "huge crisis" with DCFS in this state. They have plenty of well-paid dministrators, that's for sure. And the union staff all got really nice raises and a nice contract last year. They are giving out lots of nice contracts. They can probably afford the sweeps.
Anon 12:26 PM -- the solution is in the Constitution. The legislative branch is the branch of govt authorized to appropriate funding. It seems so simple, yet the Gov apparently considers the Constitution a "set of helpful hints."
