NEW DATE AND FORMAT - COME TO #DERVOS 2026 on Nov. 5, then join us for a founder workshop and lunch on Nov. 6! Event Title: Founders Prosperity Forum: Identify Your Alpha. Register here: https://luma.com/ux18cbjl In New York City on November 6, we're bringing together 25 founders building across energy, power, AI infrastructure, grid modernization, storage, software, and adjacent technologies. The best companies do more than solve a technical problem. They create a new layer of capability around themselves. The opportunity is to understand what that capability unlocks, how the market needs to evolve to recognize it, and how to build a durable commercial advantage around it. At Luminary Strategies, this is the work we do with companies, connecting technological capability with market architecture, regulatory innovation, private capital, and public purpose. Together with Steven Shparber and the Mintz team, we'll explore how founders can identify the strategic position their companies are uniquely equipped to own, build a compelling narrative for investors and partners, and create commercial moats that compound with the prosperity their technologies make possible. Friday, November 6 | Mintz, NYC 9:30–11:30 AM: Founder Workshops 11:30 AM–12:30 PM: Group Lunch with Mintz attorneys, including opportunities to discuss legal, regulatory, financing, IP, and company-building questions. When can an unsuccessful trade secret claim become a multimillion-dollar fee problem? That is the question before the Federal Circuit as it considers a $2.8 million attorneys’ fee award in Applied Predictive Technologies v. MarketDial. The plaintiff lost after the court found that it had not identified its alleged trade secrets with enough specificity. Now, the court is considering whether the record supports a finding of bad faith that would justify requiring the plaintiff to pay the other side’s legal fees. The case could help clarify when weak trade secret identification is simply grounds for losing a claim and when additional conduct transforms it into a costly fee issue. A few best practices for companies considering trade secret litigation: • Investigate before filing • Identify trade secrets early • Respond to the court’s concerns • Reassess when new evidence emerges • Choose precision over volume Our latest analysis examines the case and what the court’s decision could mean for trade secret plaintiffs and practitioners: https://lnkd.in/gM7kyf7M

AI is testing whether today’s boards are built for tomorrow’s decisions. Emerging risks demand thoughtful oversight and clear guardrails. At the same time, boards must be equipped to recognize new opportunities and help guide the organization’s long-term strategy. In the latest episode of Mintz On Air: Practical Policies, Jen Rubin is joined by Virginia H. Johnson, a partner at OGC (Outside General Counsel LLP), to discuss how organizations can strengthen board effectiveness in an AI-driven environment. Together, they explore modernizing board composition and director qualifications, encouraging candid evaluations, and aligning board recruitment and succession planning with long-term strategy.
