On October 14th, the Manhattan D.A.’s Office (DANY) announced the creation of its first Corporate Crime and Antitrust Task Force, which will focus on complex investigations of corporate and corporate executive fraud and misconduct, with the aim to “catalyze systemic reform.” Sher Tremonte attorneys Michael Tremonte, Brian Kidd, Cassie Dick, Alison Moe, Alexandra Conlon, and Benjamin J. Shack Sackler analyzed DANY’s announcement, detailing what it said, what it—importantly—did not say, and what the implications for companies are. Overall, the announcement signals increased scrutiny for companies operating in Manhattan, and given the current lack of information around Task Force investigation criteria, priority industries, and cooperation policies, it is advised that companies preemptively strengthen management oversight, internal reporting, and compliance in named Task Force areas. 🔗 Read the full client alert on our website: https://lnkd.in/ePwD3nMY

In an expert opinion published in the New York Law Journal this week, Sher Tremonte partner Justin J. Gunnell and associate Benjamin J. Shack Sackler break down what the Bartz et al. v. Anthropic PBC settlement means for future AI company compliance with copyright law. At $1.5 billion, the Bartz class action settlement fund, which was recently approved in the Northern District of California, may be the largest copyright class action settlement in history. Yet, as Justin and Ben write, “the settlement resolves dollars, not doctrine.” Despite Anthropic’s win on the question of whether it constitutes fair use to train AI models on copyrighted data, this settlement shows that fair use is still no panacea for AI companies, particularly when it comes to the procurement and storage of training data. Though the courts are still divided on what constitutes permissible conduct by AI companies that rely on copyrighted material, Justin and Ben observe that the Bartz settlement serves as a sobering reminder of the severe consequences for AI companies that find themselves on the wrong side of that line. 🔗 Read the full article on our website: https://lnkd.in/edgCHkUA

Sher Tremonte partners Michael Tremonte, Brian Kidd, Tami Stark, and Alison Moe co-authored the U.S. Q&A chapter in The Global Legal Post's recently published white-collar crime comparative guide. Responding to a set list of questions, the authors outline the principal federal statutes governing white-collar crime, their scope, principal white-collar offences, key investigative and enforcement bodies, and other important aspects of the U.S. white-collar landscape. The chapter concludes with a consideration of enforcement history, weaknesses in current enforcement, and foreseeable reforms over the next 12-18 months. 🔗 For more information: https://lnkd.in/e7PM6JDj

The DOJ's National Fraud Enforcement Division has established four investigative priorities for corporate fraud and identified a set of aggravating factors that prosecutors must weigh heavily when deciding whether to charge a company and how to resolve the case. The Division stresses that voluntary self-disclosure, cooperation, and remediation remain the surest route to a declination. At the same time, expanded whistleblower incentives and data-driven detection are shrinking the window in which a company can be the first to disclose. Sher Tremonte attorneys Brian Kidd, Cassie Dick, and Taylor Fontan examine the Division's priorities, investigative developments and policies, and their implications for companies and individual federal fraud investigations and enforcement proceedings. 🔗 Read the full client alert here: https://lnkd.in/eNdj89b4

Fifteen years ago, Justin Sher and Michael Tremonte opened the doors of a new litigation boutique. Last week, we gathered with colleagues, clients, friends, and loved ones to celebrate how far we've come together. Thank you to everyone who joined us for a memorable evening, and to everyone who has been part of the Sher Tremonte story since 2011. In the coming months, we'll be spotlighting the people, the work, and the values that have shaped our first fifteen years and will define our next fifteen. Stay tuned. #SherTremonte15 #SherTremonte #LawFirmAnniversary

Sher Tremonte associate Grace Coleman joined the Federal Bar Council First Decade Committee's "Life of a Law Clerk" panel on Sept. 16. Drawing on her clerkships with Judge Robert A. Richardson in the District of Connecticut and Judge Natasha C. Merle in the Eastern District of New York, Grace shared valuable insights on chambers life, judicial decision-making, and the lasting lessons a clerkship offers young lawyers. Thank you to the Federal Bar Council and the First Decade Committee members Benjamin J. S. (Sher Tremonte LLP) and Thomas Allen (Bleichmar Fonti & Auld LLP) for putting together such a thoughtful program. Grace's fellow panelists included Hon. Matthew S. Ackerman (Michigan Court of Appeals), Hillary Black (Binder & Schwartz), and Vincent Margiotta (Sidley Austin). We're proud to have Grace and Ben on our team. #FederalBarCouncil #LawClerks #LegalCommunity #SherTremonte
