Outdated tariff codes can have real costs for businesses. When tariff classifications and rules of origin in free trade agreements use different Harmonized System editions, businesses face additional compliance work and uncertainty when determining whether their goods qualify for preferential tariffs. This can be particularly challenging for businesses operating across multiple FTAs. Our latest policy paper examines technical rectification can help keep rules of origin aligned with changes to the Harmonized System. Read the paper: https://bit.ly/3TB9Du0 World Customs Organization

In international trade, where a product is made matters. Rules of origin determine the country a product is considered to originate from. They can influence customs duties, eligibility for preferential tariffs and the application of trade measures. For exporters and importers, understanding these rules—and maintaining the correct proof of origin—is essential for compliance and avoiding unexpected costs. #EUTrade

In February, the Supreme Court ruled the IEEPA tariffs unlawful. Customs is paying that money back with interest, but it isn't automatic. Importers have to file a claim, and CBP is accepting them in phases. Here's where things stand: ✅ Phase 1 (open since April 20): Entries CBP hasn't finalized, or finalized in the last 80 days. ✅ Phase 2 (open since June 29): Entries flagged for reconciliation where that adjustment hasn't been filed yet. ✅ Phase 3 (open as of October 6): Finally liquidated entries, but only for importers with their own Court of International Trade case, and only for entries the court has ordered CBP to reopen. Entries for importers without a court case are still being sorted out in court, so dates vary by entry and legal path. Not sure which phase your entries fall into? Could your business be owed money from tariffs you've already paid? That's a question worth revisiting following recent developments involving tariffs imposed under the International Emergency Economic Powers Act (IEEPA). A recent court decision could open the door for more importers to pursue refunds, while U.S. Customs and Border Protection continues making progress processing existing claims. For retailers who imported merchandise and paid IEEPA tariffs between February 1, 2025, and February 19, 2026, these developments are worth paying attention to. Refund eligibility depends on individual circumstances, and the legal process is still unfolding. If your business may be affected, now is a good time to check in with your customs broker, trade advisor, or legal counsel about your potential eligibility and next steps. #RetailIndustry #TradePolicy #RetailAdvocacy #ImportCompliance #SmallBusiness
