Law Arbitration is being asked to be faster, cheaper and to help the parties settle. Where is your library on that third one? Most arbitration shelves are strong on rules, awards and enforcement. The gap is what happens when the tribunal itself is expected to facilitate settlement without compromising its own award. One title in my International Arbitration & Investment Disputes collection covers exactly that: "The Arbitrator's Role as a Settlement Facilitator in International Commercial Arbitration: Toward Harmonized Transnational Standards" (Carmel Wahby, Kluwer Law International, ISBN 9789403538099). Why it's worth having: ▪ Compares how different jurisdictions handle settlement facilitation ▪ Sets out safeguards for impartiality, party autonomy and due process ▪ Safeguards you can build into arbitration agreements and institutional rules And it sits within a collection of 50 titles I curate for practitioners, arbitrators and law libraries: ▪ Institutional rules guides (ICDR, DIAC) and complex multi-party arbitrations ▪ Regional practice in Asia: Malaysia, Singapore, China ▪ Investment arbitration: enforcement of treaty awards, evidence, national security screening Explore the full collection here: https://lnkd.in/d_uA3eax Read my short blog on the settlement facilitator book: https://lnkd.in/ds8x22zJ I ship worldwide and you order directly, no waiting for a quote. If your library needs a title that isn't listed, ask me and I'll source it. #InternationalArbitration #InternationalLaw #ComparativeLaw #clnzbooks #lawbooks #lawlibrary

Does a party who challenges an arbitral award within the statutory 28-day window buy itself a longer runway to amend that challenge later? E v F concerned a State's challenge to an award made against it in an investment treaty arbitration. An amendment application was brought 162 days after the award, more than five times the statutory deadline. While the amendment did not raise a new ground of challenge and the original challenge had been filed in time, the application was refused. The decision is a clear warning against treating an in-time challenge as a placeholder to be revisited later. Parties considering a challenge to an English-seated arbitral award should treat the 28 days as running from the moment the award, or any relevant correction or appeal decision within the arbitration, is issued, and the full scope of the challenge should be identified and pleaded from the outset.
