Law Arbitration is being asked to be faster, cheaper and to help the parties settle. Where is your library on that third one? Most arbitration shelves are strong on rules, awards and enforcement. The gap is what happens when the tribunal itself is expected to facilitate settlement without compromising its own award. One title in my International Arbitration & Investment Disputes collection covers exactly that: "The Arbitrator's Role as a Settlement Facilitator in International Commercial Arbitration: Toward Harmonized Transnational Standards" (Carmel Wahby, Kluwer Law International, ISBN 9789403538099). Why it's worth having: ▪ Compares how different jurisdictions handle settlement facilitation ▪ Sets out safeguards for impartiality, party autonomy and due process ▪ Safeguards you can build into arbitration agreements and institutional rules And it sits within a collection of 50 titles I curate for practitioners, arbitrators and law libraries: ▪ Institutional rules guides (ICDR, DIAC) and complex multi-party arbitrations ▪ Regional practice in Asia: Malaysia, Singapore, China ▪ Investment arbitration: enforcement of treaty awards, evidence, national security screening Explore the full collection here: https://lnkd.in/d_uA3eax Read my short blog on the settlement facilitator book: https://lnkd.in/ds8x22zJ I ship worldwide and you order directly, no waiting for a quote. If your library needs a title that isn't listed, ask me and I'll source it. #InternationalArbitration #InternationalLaw #ComparativeLaw #clnzbooks #lawbooks #lawlibrary

Inter-state arbitration can work because of the “opprobrium” states face if found in breach of international law, former chief of investment arbitration at the US Department of State David Bigge has said, but for it to be an affirmative peace-keeping choice for political leaders it needs to be less formal and legalised, with bespoke processes and scope for tribunals to consider equity. Alison Ross reports. https://lnkd.in/efdGeaHB

Hong Kong plans to establish the Hong Kong International Commercial Court (HKICC) by 2027 as a dedicated forum for high-value cross-border commercial disputes. The HKICC could be especially useful for disputes involving international trade, finance, investment and cross-border transactions between Mainland Chinese and international parties. Commenting on the development, Soo Khim Keoy, partner and Head of Commercial Litigation in Hong Kong, told Commercial Dispute Resolution (CDR) that the HKICC could fill an important gap in the market by combining "the transparency and authority of court judgments with the efficiency and expertise associated with arbitration". The relationship between Private International Law and investment arbitration was the focus of a panel held on 29 September 2026 at the 22nd General Congress of the International Academy of Comparative Law in Berlin (28 September – 2 October), at which Jose Antonio Moreno Rodriguez presented an excellent General Report on the topic. Moderated by Christian Tietje, the panel also featured contributions by Hugo Cardona (MCIArb), Alexandra Dougka, Mohamed AM Ismail, Maria-Chiara Malaguti, Alina Oprea, Giuseppe Proietti, Veronica Ruiz Abou-Nigm, Grzegorz Żmij and myself, who examined the topic from a variety of angles. I had the opportunity to present the main conclusions of my report on Private International Law and Investment Arbitration in the European Union, a field shaped by significant recent developments in arbitral and national case law, and one that continues to raise largely unresolved questions. The discussion was rich and stimulating, and will soon give rise to a collective volume. #IACL #ComparativeLaw #PrivateInternationalLaw #InvestmentArbitration #EULaw #ISDS
