YOUR USE OF THE MS NOW WEBSITES, EVENTS, PRODUCTS AND SERVICES ARE GOVERNED BY THE VERSANT TERMS OF SERVICE (“Versant ToS”), PRIVACY POLICY, THE RELEVANT SUPPLEMENTAL TERMS, AND ANY OTHER DOCUMENTATION, POLICIES, OR GUIDELINES THAT WE MAY PROVIDE IN WRITING.

IMPORTANT NOTE: THE VERSANT TERMS OF SERVICE, WHICH ARE INCORPORATED INTO THE TERMS, INCLUDE A MANDATORY BINDING ARBITRATION PROVISION.

MS NOW Membership Terms

  1. General.  The terms and conditions set forth below (these “Terms”) constitute the terms of subscriptions to the products and services of MS NOW Cable, LLC (“MS NOW”). To purchase a subscription to this MS NOW service (“Subscription”), you must be at least eighteen (18) years of age or the applicable age of majority in your jurisdiction of residence.  Prior to making such purchase, you must provide us with a valid payment method (e.g., credit card, debit card, other payment account, etc.) (“Payment Method”) and associated payment information including all of the following: (a) your name as it appears on the Payment Method, (b) your Payment Method number, (c) the Payment Method type, (d) the date of expiration and (e) any activation numbers or codes needed to charge your Payment Method (collectively, “Account Details”).  By submitting any information to us or our third-party payment processor, you agree that you authorize us and/or our processor to charge your card/account at our convenience. For any subscription that you purchase, you agree to pay the price applicable (including any sales taxes, delivery fees and surcharges, if applicable) as of the time you complete the purchase. You agree to provide accurate Account Details during the Subscription Term (as defined in Section 2 (Subscription Term & Termination) below). WHEN YOU CLICK SUBSCRIBE OR OTHER CONFIRMATION BUTTON, WE WILL AUTOMATICALLY BILL YOUR PAYMENT METHOD SUBMITTED DURING THE SUBSCRIPTION PAYMENT PROCESS. YOU HEREBY AUTHORIZE US TO BILL YOUR PAYMENT METHOD THE FEES LISTED ON THE SITE FOR THE SUBSCRIPTION PLAN PURCHASED BY YOU. We reserve the right to modify, terminate or otherwise amend our offered subscription plans. By purchasing a Subscription, you acknowledge that you have read and agree to these Terms, as well as the Versant Terms of Service, which are incorporated herein by reference and available at https://www.versantmedia.com/terms.
  2. Subscription Term & Termination.  Except in the event of a trial offer, as described below, your Subscription will commence as of the date your payment for a Subscription is received by MS NOW.  Your Subscription will continue in full force for the length of the term you specifically purchased (e.g., monthly, yearly, etc.) until such time as you cancel the subscription as further explained below (the “Subscription Term”).  In the event that you cancel a Subscription in the middle of your Subscription Term, you will not be entitled to receive a refund for the unused portion of the remainder of that Subscription Term unless required by law.  MSNOW will have the right, upon written notice to you, to terminate these Terms, and suspend your account and access to your Subscription benefits, if: (a) you fail to pay MS NOW any amount due to MS NOW under these Terms; and/or (ii) you materially breach any term or condition of these Terms, the Community Guidelines [VL1] or other policies provided to you in connection with your Subscription. MS NOW shall have the right to terminate these Terms and suspend your access to your subscription with or without cause, upon thirty (30) days’ written notice to you, in which case you will no longer be charged for access to the Subscription benefits.  Upon the expiration or termination of these Terms for any reason, your access to, and use of, the Subscription benefits will terminate.
  3. Free Trials and Promotional Offerings.  We may offer promotional trials to Subscriptions for free for a limited time or at special discounted prices (each, a “Trial”).  If you sign up for a Trial, your rights to the Subscription benefits are limited by the terms of such Trial and will terminate or renew on the terms of such Trial.  Please be aware that when you sign up for a free Trial, you may be required to provide your Payment Method information, and MS NOW will confirm your Payment Method is valid; provided, however, that your Payment Method will not be charged unless your Subscription renews in accordance with the Trial’s terms and as more fully described below.  When we process your credit card, some credit card companies may place a temporary hold on your account for your first payment.  Please contact your card issuer or financial institution if you have questions.  Please note that we do not provide price protection or refunds in the event of a price drop or promotional offering.

    IF YOU ARE REQUIRED TO ENTER PAYMENT INFORMATION TO RECEIVE YOUR FREE TRIAL, ONCE YOUR FREE TRIAL ENDS, THE PRICE WILL INCREASE TO THE THEN-CURRENT SUBSCRIPTION PRICE AS SPECIFIED IN YOUR SUBSCRIPTION PLAN, AND WE OR A THIRD PARTY WILL BEGIN BILLING YOUR DESIGNATED PAYMENT METHOD ON A RECURRING BASIS FOR YOUR SUBSCRIPTION (PLUS ANY APPLICABLE TAXES AND OTHER CHARGES) FOR AS LONG AS YOUR SUBSCRIPTION CONTINUES, UNLESS YOU CANCEL YOUR SUBSCRIPTION PRIOR TO THE END OF YOUR FREE TRIAL.  INSTRUCTIONS FOR CANCELING YOUR SUBSCRIPTION ARE DESCRIBED BELOW. WE RESERVE THE RIGHT TO MODIFY OR TERMINATE FREE TRIALS AT ANY TIME, WITHOUT NOTICE AND IN OUR SOLE DISCRETION.
  4. Auto-Renewal of Subscriptions.  If you purchase a Subscription, your Subscription will automatically renew at the end of your Subscription Term continuously and indefinitely without action by you, and the subscription fee will be charged to your Payment Method on file at the time of renewal, until you cancel via the cancellation method described in Section 5 (Cancellation of Subscription) below.  A subscriber whose subscription fee has been paid is entitled to all privileges included in the applicable Subscription until the Subscription is cancelled by the subscriber as set forth in Section 5 below. By providing your Payment Method information for your Subscription, you are agreeing to pay a subscription fee that will automatically renew at the then current rate, plus any applicable taxes and service fees, unless you cancel prior to the expiration of the current Subscription Term (collectively, the “Fees”).  The Fees will be charged to your original Payment Method automatically at the beginning of your Subscription Term, and at the beginning of each renewal Subscription Term thereafter, on the calendar day corresponding to the commencement of your current Subscription Term, unless you cancel your subscription or your account is suspended or terminated pursuant to these Terms.  The renewal Subscription Term will be the same length as your initial Subscription Term unless otherwise disclosed to you at the time of sale of the original Subscription plan.  The rate for the renewal Subscription Term will be the then-current Subscription rate.  The Fees charged to your Payment Method may vary from Subscription Term to Subscription Term due to changes in your Subscription plan or applicable taxes, and you authorize MS NOW to charge your Payment Method for these amounts.  MS NOW reserves the right to change the pricing of a Subscription at any time.  In the event of a price change, MS NOW will post the new pricing on the MS NOW website and mobile app and as otherwise required by law.  You agree that we may change the pricing we charge you for your subscription and any products/services offered in your subscription package by providing you with notice through an electronic communication from us and you agree that all agreements, notices, disclosures and other communications that we provide to you or post electronically satisfy any legal requirement that such communications be in writing.  You consent to our ability to change our pricing and the details of our Subscription packages through an electronic communication to you.  If you do not wish to accept a price or Subscription package change made by us, you may cancel your Subscription as described below; otherwise, you will be deemed to have consented to the price/subscription package change and authorize MS NOW to charge the new Fees to your Payment Method. 
  5. Cancellation of Subscription.  You have the right to cancel your Subscription at any time.  If you purchased your Subscription online, to cancel your Subscription, navigate to your Membership settings, click on Manage Membership and switch autorenewal to Off. You can also cancel by contacting Customer Support at support@ms.now. If you purchased your Subscription the Apple App Store, Google Play or other third-party application marketplace (an “App Store”), you must cancel through the app account settings of the applicable App Store. MS NOW cannot cancel an App Store subscription on your behalf. Deleting your account or deleting the app from your device does not automatically cancel your Subscription. Subscribers will be eligible to access the Subscription benefits until their next scheduled payment date, at which point the Subscription is cancelled, and no more payments will be processed. If you have issues cancelling your Subscription, please contact us for assistance by contacting Customer Support at support@ms.now.  Except as noted in Section 7 (Refund Policy) below, cancellation of a Subscription any time after purchase will result in forfeiture of the Fees.  To avoid forfeiture of a Subscription renewal fee, subscription should be cancelled prior to the end of the then-current Subscription Term.  Upon cancellation, you will lose access to the Subscription benefits.  This could include any credit and other data and analyses that have been displayed during your Subscription.
  6. Methods of Payment, Terms and Taxes.  All payments must be made through any of the methods that are accepted at the time of payment by us or by our payment services provided, which may include the following methods: Visa, Mastercard, American Express, Discover and any other Payment Methods we may offer in the future. We currently do not accept cash, personal or business checks or any other payment form, although in the future, we may change this policy. Your card issuer or financial institution agreement governs your use of your designated card or payment account, and you must refer to that agreement and not these Terms to determine your rights and liabilities as a card or account holder. If you use a debit card, Subscription charges will be deducted from the bank account linked to that card. You are responsible for maintaining sufficient funds and for any overdraft, insufficient funds or other fees charged by your financial institution. If for any reason your default Payment Method is declined, we will retry your Payment Method a reasonable number of times. If your default Payment Method continues to be declined or is no longer available, you authorize us to charge any other Payment Method that you have authorized for use on your account with us. You will remain responsible for any uncollected amounts. You represent and warrant that you will not use any credit card or other form of payment unless you have all necessary legal authorization to do so. YOU, AND NOT MS NOW, ARE RESPONSIBLE FOR PAYING ANY UNAUTHORIZED AMOUNTS BILLED TO YOUR PAYMENT METHOD BY A THIRD PARTY. You agree to pay all fees and charges incurred in connection with your purchases (including any applicable taxes) at the rates in effect when the charges were incurred. Unless you notify MS NOW in writing of any discrepancies within forty-five (45) days after they first appear on your credit card statement, you agree that they will be deemed accepted by you for all purposes. If MS NOW does not receive payment from your credit card issuer or its agent, you agree to pay all amounts due upon demand by MS NOW or its agents. Sales taxes or other taxes, customs, import/export charges or similar governmental charges are not included in the price of the products. You are responsible for paying any such taxes or charges imposed on your purchases, including, without limitation, sales, use or value-added taxes. MS NOW shall automatically charge and withhold the applicable tax for orders to be delivered to addresses within any states or localities that it deems are required in accordance with our order policy in effect at the time of purchase.

    If you purchase a subscription through an App Store, your purchase and payment transaction are processed and administered by the applicable App Store, not by MS NOW. The App Store, and not MS NOW, controls payment authorization, charging and renewal of your selected payment method, payment-related account management and the processing of any available refunds, subject to its terms and applicable law.
  7. Refund Policy.  All purchase transactions are subject to MS NOW’s return policy in effect at the time of purchase. Currently, MS NOW’s refund policy is to not offer any refunds, except in its sole and absolute discretion.
  8. No Responsibility to Offer Mispriced Subscription.  We do our best to describe every Subscription plan and Subscription benefits as accurately as possible.  However, we are human, and therefore, we do not warrant that specifications or pricing of different Subscription plans is complete, accurate, reliable, current or error-free.  In the event of any errors relating to the pricing or specifications, MS NOW shall have the right to revoke any stated price and to correct the error, inaccuracy or omission (including after a purchase has been made) or to refuse or cancel any orders in its sole discretion (including any accepted orders).  If we charged your credit card or other account prior to cancellation, we will issue a credit to your account in the amount of the charge.   
  9. Modifications to Prices or Billing Terms. All descriptions, images, references, features, content, information, specifications, products and prices described or depicted in connection with the Service are subject to change at any time without notice.We cannot and do not guarantee the accuracy of completeness of any information, including prices, images, specifications, availability and services, including for those provided by third parties (if any). Descriptive, typographic and photographic errors are subject to correction, and we shall have no liability of any kind for such errors. PRODUCTS AND SERVICES INCLUDED IN YOUR SUBSCRIPTION MAY NOT BE AVAILABLE AT ALL TIMES AND MAY BE SUBSTITUTED OR DISCONTINUED AT ANY TIME.  IN ACCORDANCE WITH THESE TERMS, MS NOW RESERVES THE RIGHT, AT ANY TIME, TO CHANGE ITS PRICES AND BILLING METHODS, EFFECTIVE IMMEDIATELY UPON POSTING ON MS NOW WEBSITE AND MOBILE APP OR BY E-MAIL DELIVERY TO YOU.

MS NOW Events Supplemental Terms

These Supplemental Terms of Service for MS NOW Events (“Supplemental Terms”) apply to your attendance, participation in and/or access to any in-person or virtual event, meeting, show, seminar, webinar, or conference owned, operated or otherwise hosted by us, including any recordings or live streams of the foregoing (each, a “MS NOW Event”).

By accepting and using your registration, ticket or other means of access (each, a “Ticket”) to the applicable MS NOW Event, you are agreeing, on behalf of yourself and any other individual who will be attending the MS NOW Event via a Ticket purchased or otherwise supplied by you (each, a “Guest”), to these Supplemental Terms.

BY ATTENDING A MS NOW EVENT AND OR PURCHASING A TICKET, YOU FURTHER ACCEPT AND AGREE TO BE BOUND AND ABIDE BY THESE SUPPLEMENTAL TERMS.

Capitalized terms not defined below will have the meanings given to such terms in the Versant ToS. We may modify the Supplemental Terms and encourage you to check back here from time to time for any modifications we may make to these Supplemental Terms.

To the extent there is a conflict between these Supplemental Terms (including the Versant ToS) and the information on the MS NOW Events website, these Supplemental Terms will prevail with respect to such conflict.

  1. Ticketing

1.1. Personal. The Ticket is a personal, revocable license to attend the MS NOW Event to which the Ticket relates. Capacity for MS NOW Events is limited, and a Ticket is required to attend any MS NOW Event. You confirm that your attendance at the MS NOW Event complies with all applicable laws and regulations and your organization’s internal policies and guidelines.

1.2. Acceptance of Terms by Guest. If you are obtaining a Ticket to a MS NOW Event on behalf of a Guest, it is your responsibility to ensure your Guest is aware of these Supplemental Terms and accepts them. By obtaining a Ticket on behalf of a Guest, you are warranting that you have made your Guest aware of these Supplemental Terms and they have accepted these Supplemental Terms.

1.3. Non-Transferable Ticket. Notwithstanding the foregoing, your Ticket is non-transferable unless such Ticket transfer, assignment and/or substitution request is approved in writing by us. To request to transfer your Ticket, please check the event page for the applicable MS NOW Event for instructions on how to do so or email events@ms.now. Your Ticket will not be honored if obtained from unauthorized sellers. Your Ticket has no value, cash or otherwise, and may not be sold, resold, copied or exchanged under penalty of law. Your Ticket may not be used for advertising, marketing, promotions or any other commercial purpose, including, without limitation, contests, auctions, sweepstakes and giveaways without our express written consent. Any such attempted or actual sale, transfer or use of your Ticket invalidates your Ticket and revokes any license granted thereunder.

1.4. Payment Method. If applicable, the payment of any fee for a MS NOW Event is due upon purchase of your Ticket. Unless otherwise noted, the total price of the Ticket is inclusive of any applicable sales or use taxes. Any and all other costs incurred in connection with your attendance of the MS NOW Event shall be borne solely by you, and we are not responsible for any such costs. You hereby represent and warrant that any payment information you submit to us is true, accurate and complete and that you have the legal right to use any credit card(s), debit card(s) or other payment method(s) (“Payment Method”) used by you in connection with your Ticket purchase. By providing a Payment Method for your Ticket purchase, you expressly agree that we, our affiliates or a third‑party payment processor is authorized to charge the Payment Method provided at the time of your Ticket purchase and in accordance with any future payment dates agreed upon at the time of sale. If we cannot charge your Payment Method or if your Payment Method is denied for any reason, we reserve the right to deny you access to the MS NOW Event.

1.5. No Refunds. Unless otherwise noted in writing, all Ticket purchases are final and non-refundable. Please note that if you do not attend a MS NOW Event for which you have purchased a Ticket, or leave such MS NOW Event prior to its conclusion, you are still responsible for payment. You and any Guest’s sole and exclusive remedy for dissatisfaction with a MS NOW Event is to leave the event. Unless otherwise noted in writing, there are no refunds, credits or exchanges for illness, emergencies or any other unexpected circumstances affecting your or a Guest’s attendance of a MS NOW Event.

1.6. Invitation-only MS NOW Events. Certain MS NOW Events may be invitation-only. You may have an opportunity to request an invitation to attend such MS NOW Events, but admission to attend such MS NOW Events is subject to our sole discretion. Please note that requesting an invitation to attend an invitation-only MS NOW Event does not guarantee admission.

1.7. Admission, Attendance and Removal. We reserve the right to exclude any prospective participant from registering for, participating in, or attending any MS NOW Event, in our sole discretion. We also reserve the right to admit and remove any Guest at any time during an MS NOW Event in our sole discretion.

1.8. Privacy. Our Privacy Policy explains how we collect, store, process and use your data, including your Payment Method information, and you acknowledge and agree that you and any Guest’s registration, attendance, participation in and/or access to a MS NOW Event is subject to the terms and conditions of our Privacy Policy.

1.9. No liability. You shall be solely liable for and assume all risk of: (i) loss of or damage to any property owned by you or otherwise in your possession or control during the Event; and (ii) death or personal injury that you may suffer during the Event, which is not caused by our negligence. To the maximum extent permitted by law, MS NOW expressly excludes all representations, warranties and obligations arising out of or in connection with the Event. Under no circumstances whatsoever shall MS NOW be liable to you, whether in contract, tort, breach of statutory duty or otherwise, for any direct, indirect, consequential, special, incidental or punitive loss or damage arising from or in connection with the Event.  You hereby irrevocably, fully and unconditionally release Versant Media, MS NOW, their employees, officers, affiliates, contractors, suppliers, customers, sponsors and licensees from and against any liability whatsoever (whether direct or indirect and whether arising in contract, tort, breach of statutory duty or any otherwise) arising out of or in connection with the Event.

  1. Event Content

2.1. Changes to Date and Content. We reserve the right, in our sole discretion, to cancel, delay or change any and all aspects of a MS NOW Event, including, but not limited to, the theme, content, programs, speakers, performers, hosts, moderators, venue, date and time. Unless otherwise noted in writing, you acknowledge and agree that any such cancellations or changes are not grounds for a refund of any registration or attendance fees paid in connection with such MS NOW Event.

2.2. Hosts and Speakers. The views, opinions and positions expressed by the hosts, speakers or sponsors of MS NOW Events or any other third parties at MS NOW Events are theirs alone and do not necessarily reflect the views, opinions or positions of Versant Media or its affiliates. We make no representations as to the accuracy, completeness, timelines, suitability or validity of any information represented by hosts, speakers, attendees or sponsors at a MS NOW Event. You acknowledge that any reliance upon any such information shall be at your sole risk.

2.3. Third Parties. Any third-party goods and/or services that are provided in connection with a MS NOW Event are provided in accordance with their own terms and conditions. By attending a MS NOW Event, you, on behalf of yourself and any Guest, agree to abide by the terms and conditions imposed by any such third party. You understand that violation of any such third party’s terms and conditions may result in you and/or any Guest being denied access to the applicable aspect of the MS NOW Event. You further acknowledge and agree that MS NOW makes no representations or warranties about any third-party goods and/or services provided in connection with a MS NOW Event and shall bear no responsibility for any personal injury, death or other harm experienced by you or any Guest as a result of such third-party goods or services.

2.4. Attendee Information. As a condition of registering for MS NOW Events, the information you provide may be shared with the MS NOW Event sponsors.

  1. Participation Requirements; Prohibited Conduct

3.1. License to Footage. By attending or accessing a MS NOW Event, you, on behalf of yourself and any Guest, hereby irrevocably grant Versant Media and its affiliates, partners, advertisers, designees and licensees the unlimited, irrevocable, royalty-free, worldwide right to film, record and photograph you and any Guest and to use your and any Guest’s name, image, likeness, avatar, voice, sobriquet and information or comments about you and any Guest, including, without limitation, any photographs, recordings, and/or audio taken of you or any Guest during the MS NOW Event (collectively, the “Footage”), and to exploit, edit, publish, broadcast, display, distribute and otherwise use the Footage in any and all media for any purpose, including, but not limited to, in connection with the development, production, distribution, and/or exploitation of the MS NOW Event and/or other Versant Media productions or events and in marketing, advertising, and promotional materials for the MS NOW Event and/or other Versant Media productions, including those intended for broadcast on a television network, streaming on a digital programming service, and/or any other platform of Versant Media or any third party. You, on behalf of yourself and any Guest, further grant Versant Media and its partners, advertisers, designees and licensees the right to use the Footage throughout the universe at any time, in perpetuity, in any and all media now known and hereafter devised in any manner including, without limitation, online, on-air, in social media, out-of-home, print and/or in other production(s), including, but not limited to, for advertising, sponsorship or commercial purposes, in all cases without compensation or attribution to you or any Guest. You, on behalf of yourself and any Guest, acknowledge that use of the Footage may be brought to you by, sponsored, tagged or otherwise associated with us and/or our advertisers and sponsors and feature the brands, products and/or services of those other companies. We shall have and own all rights (including, without limitation, copyrights) in and to the Footage and you hereby waive all rights in and to the Footage, including, but not limited to, all claims of so-called moral rights. The rights granted herein shall also include the right to edit, delete, dub, and exploit the Footage as we see fit in our sole discretion.

3.2. No Recording. Unless otherwise specified, all MS NOW Events are on the record for journalistic and editorial purposes. Unless otherwise specified, no outside video or still cameras are permitted at MS NOW Events and any photography, video or audio recordings or broadcasting of MS NOW Events by attendees is strictly prohibited.

3.3. Security and Health Screenings. Entry to any in-person MS NOW Event may be subject to biometric scans, health screenings (e.g., temperature checks) and/or reasonable searches for certain prohibited items, including, without limitation, weapons, outside food and beverage, and illegal and controlled substances. You are required to comply with all rules and instructions provided by us at any time before or during a MS NOW Event, including, but not limited to, applicable privacy laws, anti-corruption laws, and health and safety instructions for in-person events, such as wearing a face covering or mask, maintaining social distancing and abiding by any applicable rules of the event venue.

3.4. No Commercial Activity. No sponsorship, on-site marketing, sampling, vending, coupon/product distribution or other promotional, commercial or advertising activity may be conducted at any MS NOW Event without our prior written consent.

3.5. Revocation of Ticket. We reserve the right to revoke your or any Guest’s access to a MS NOW Event (without any refund of any portion of the Ticket price paid, if applicable) (a) if we, in our sole discretion, determine that your or any Guest’s participation or behavior creates a disruption or hinders the MS NOW Event or the enjoyment of the MS NOW Event content by other attendees, (b) if you or any Guest fail to comply with or violate any MS NOW Event rules or guidelines, these Supplemental Terms or applicable laws, or (c) for any other reason whatsoever.

3.6. Technical Issues. You are responsible for procuring the necessary equipment and the payment of any charges necessary to access the MS NOW Events. For any online or virtual MS NOW Events that you or a Guest attend, we are not responsible for the reliability, continued availability, speed or quality of the telecommunications lines and/or equipment that you or any Guest uses to access such MS NOW Events, including but not limited to you or your Guest’s use of a Ticket. It is your responsibility to ensure that your or any Guest’s systems are compatible with our technology or the technology of any third-party platform we use for an online or virtual MS NOW Event (if applicable) prior to registering for such MS NOW Event. We are not liable or responsible for any technical issues which may arise as a result of your failure to ensure compatibility of our technology with your systems. Similarly, we are not liable or responsible for any delay, disruption or disturbance in the operation of the internet or problems caused by your or any Guest’s internet service provider, any third-party platforms used in connection with a MS NOW Event, or for any telecommunications failures that are beyond our control

  1. Public Health Protocols; COVID-19 and Infectious Disease Risk Acknowledgement

4.1. Health Protocols. By participating in any in-person MS NOW Event, you understand that our policies, CDC guidelines in relation to infectious diseases, event venue policies, and the requirements or recommendations of federal, state, and/or local health officials must be followed by you and any Guest. In-person MS NOW Events may have enhanced health and safety measures in place, including, but not limited to, masking, proof of COVID-19 vaccination or a negative COVID-19 test, and health and safety protocols, including vaccination requirements, are subject to change at any time in our sole discretion, in accordance with CDC guidelines, event venue policies, and/or the requirements or recommendations of federal, state, and/or local health officials. Refunds will not be provided if you or any Guest is denied access to a MS NOW Event for failure to follow such protocols.

4.2. Assumption of Risk. You acknowledge and understand, on behalf of yourself and any Guest, that any public location where people are present provides an elevated, inherent risk of exposure to COVID-19 and other communicable and/or infectious diseases, and we do not guarantee that any person attending an in-person MS NOW Event will not be exposed. By attending an in-person MS NOW Event, you, on behalf of yourself and any Guest, expressly assume the risk that, during your participation in such MS NOW Event, you and any Guest may be exposed to communicable and/or infectious diseases, including but not limited to COVID-19. You expressly understand that these risks include contracting COVID-19 or other communicable and/or infectious diseases and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other communicable and/or infectious diseases. You release, covenant not to sue, and forever discharge MS NOW from any claim that you contracted or suffered injury from COVID-19 and/or any other communicable and/or infectious disease while in attendance at a MS NOW Event, whether such injury occurred before, during or after contact with the MS NOW Event, including all liabilities, losses, claims, actions, damages, costs or expenses of any kind (including reasonable attorneys’ fees) arising out of or relating thereto.
