𝐀𝐟𝐫𝐢𝐜𝐚–𝐀𝐬𝐢𝐚 𝐓𝐫𝐚𝐧𝐬𝐚𝐜𝐭𝐢𝐨𝐧𝐬: 𝐏𝐞𝐫𝐬𝐩𝐞𝐜𝐭𝐢𝐯𝐞𝐬 𝐟𝐫𝐨𝐦 𝐭𝐡𝐞 𝐄𝐚𝐬𝐭 𝐀𝐟𝐫𝐢𝐜𝐚 𝐈𝐧𝐭𝐞𝐫𝐧𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐀𝐫𝐛𝐢𝐭𝐫𝐚𝐭𝐢𝐨𝐧 𝐂𝐨𝐧𝐟𝐞𝐫𝐞𝐧𝐜𝐞 2026 Following the inaugural Kigali Arbitration Week, we were pleased to continue our Rwanda journey at the East Africa International Arbitration Conference 2026 in Kigali. Our Partner, Gustavo Laborde, participated in the masterclass "Drafting Effective Arbitration Agreements for Africa–Asia Transactions", moderated by Aimé Mbarushimana (Chair, CIArb Rwanda), alongside fellow panelists Nikhil Desai (JMiles & Co.), David Kaggwa, FCIArb (Kaggwa & Kaggwa Advocates), and Adv. Nkundabarashi Moïse (Advocate, speaking on behalf of the Rwanda Bar Association). The panelists examined a practical example of a defective arbitration clause; discussed simple drafting techniques to ensure arbitration clauses are enforceable; and shared insights and practical perspectives on how to tailor an arbitration clause to the realities of the transaction, while bridging differences between African and Asian parties hailing from different legal traditions. Focus on the legal seat, the institution and rules, and the method of appointment of arbitrators. Our thanks to Kidist Dawit, Edith Twinamatsiko, MCIArb, Agnes Gitau and Elodie Dulac, FCIArb, for putting together such a great and well-run programme, and for the warm welcome extended to all who took part.

𝐀𝐫𝐛𝐢𝐭𝐫𝐚𝐭𝐢𝐨𝐧, 𝐓𝐫𝐚𝐝𝐞 & 𝐈𝐧𝐯𝐞𝐬𝐭𝐦𝐞𝐧𝐭: 𝐑𝐞𝐟𝐥𝐞𝐜𝐭𝐢𝐨𝐧𝐬 𝐟𝐫𝐨𝐦 𝐊𝐢𝐠𝐚𝐥𝐢 Our Rwanda trip got off to a great start with the inaugural Kigali Arbitration Week 2026. Partner Gustavo Laborde joined the panel "Arbitration in a Global Economy: Advancing Trade, Investment & Commercial Justice", alongside Muganga Didas Kayihura (University of Rwanda), Aisha Abdallah (ALN Kenya), and Prof. Wyne Kenneth (CIArb Kenya, C.Arb), moderated by Faustin Ntwari (CIArb). The panel explored how arbitration enables international trade and investment, contributes to the AfCFTA and regional economic integration, and instills confidence in businesses and investors operating in cross-border settings. It was a pleasure to connect with colleagues and friends from Rwanda, East Africa and the international arbitration community, to exchange perspectives on the opportunities and challenges shaping arbitration in the region. Rwanda has a young, ambitious, multilingual and industrious population, with a hybrid civil law-common law tradition, and has already established itself as a regional hub in East Africa. This augurs well for the future of international arbitration in Rwanda and, most importantly, for the future of Rwanda and Rwandans in international arbitration. A big thank you to the organising committee, with particular thanks to Mispa FRI AWASUM, and CIArb Rwanda Branch, for bringing together such a thoughtful and engaging programme. We look forward to staying in touch.

Laborde Law are grateful for the opportunity to contribute to the Bocconi International Arbitration Conference 2026, held on 21–22 May at Bocconi University, in Milan. This year's conference tackled a timely and ever pressing theme for the arbitration community: Ethics in International Arbitration — Self-Regulation, Accountability, and the Future of Professional Conduct. Umberto Novara, Associate at the firm, participated in the Mock Supreme Court Appeal — a simulated appellate hearing before a bench of real Supreme Court Justices from various jurisdictions. The Mock saw young arbitration lawyers argue a moot case involving allegations of misconduct, its impact on the award, and the limits of judicial review. Laborde Law supported the conference through two scholarships for participants. Our warm thanks to the organizers — Catherine A. Rogers, Anna Chiara Amato, Lyra Çela and Anna Biasiolo — for putting together such a stimulating two days at the crossroads of ethics, procedure, judicial review, and the evolving standards governing our profession.

The case is about the non-compliance with obligations under the Espoo Convention and the SEA Protocol, including obligations relating to transboundary consultation and the conduct of a procedurally compliant 𝘦𝘹 𝘢𝘯𝘵𝘦 transboundary environmental impact assessment. During the session, the Bosnia and Herzegovina delegation addressed the Committee’s questions in detail and provided extensive supporting evidence. Croatia requested additional time to respond in writing to a number of questions raised by the Committee. Bosnia and Herzegovina also raised serious concerns about the timing, methodology and credibility of Croatia’s Environmental Impact Study, including the manner in which data relating to potential transboundary effects was collected and assessed. The Study is expected to be published later this year. The Bosnia and Herzegovina delegation included 𝐁𝐨𝐣𝐚𝐧 𝐕𝐢𝐩𝐨𝐭𝐧𝐢𝐤, Minister; Nasiha Pozder, Minister; 𝐄𝐦𝐢𝐫 𝐃𝐢𝐳𝐝𝐚𝐫𝐞𝐯𝐢ć, Chair, Expert Team; Zoran Drace, Expert Team; 𝐁𝐨𝐫𝐢𝐬𝐥𝐚𝐯 𝐁𝐨𝐣𝐢ć, Coordinator of the Legal and Expert Teams; Slaven Soldo, Head of Department, Ministry of Foreign Affairs; Mario Crnković, Expert Team, Novi Grad; and 𝐃𝐞𝐣𝐚𝐧 Ć𝐨𝐬𝐢ć, Chief of Staff. The Laborde Law team included Gustavo Laborde, Professor Mirjana Drenovak-Ivanovic, and Nemanja Galić. Laborde Law remains committed to representing and protecting the interests of Bosnia and Herzegovina in proceedings before international bodies and organizations.
