Following introductory remarks by professor Gabriella Blum, Yas Banifatemi and professor Mark Wu, Professor Sean D. Murphy, Manatt/Ahn Professor of International Law at George Washington University, discussed the "Effects of the ILC's Articles on State Responsibility for Temporal Jurisdiction in International Arbitration". We sincerely thank Professor Murphy for delivering this lecture and for his insightful remarks, and to Harvard Law School for co-hosting this annual series in honor of Professor Gaillard’s contributions to the field. We have had the privilege of being appointed by LexisNexis as the scientific directors and general editors of this new publication. We accepted this role with the ambition of creating a truly global platform for the study of international arbitration, ensuring that diverse perspectives and voices from around the world are heard. International Arbitration Perspectives will highlight key developments in the field, foster cross-jurisdictional debate while remaining focused on the truly international nature of the field, engage with sister fields (such as public international law), and introduce new disciplines such as ethics in international arbitration. With the support of authors and correspondents from around the world, each issue will pair a global watch on recent developments – organised by legal question rather than country – with in-depth articles on theoretical and practical questions arising in international arbitration. Yas Banifatemi a republié ceciYas Banifatemi a republié ceciLast evening at the Cercle de l'Union Interalliée, Paris marking the Arbitration Academy 15th anniversary, Yas Banifatemi delivered the 2026 Goldman Lecture with rare courage — Anglo-Iranian Oil Co. (UK v Iran): Sovereign Vision and International Law. To lay bare, so plainly, how power bends the law took real boldness, and I am grateful for it. The case is no dry jurisdictional footnote. Beneath the procedural argument lay a deeper contest — over what an international court is for, in a world turning from empire to independence. Mossadegh nationalised Iran's oil to reclaim it for his people; in 1952 the International Court of Justice (ICJ) vindicated Iran, holding that a concession between a State and a foreign company was no treaty it could enforce. Law had spoken for the weak against the strong. Then came the shame. Within a year, the very powers that built the international legal order — Britain and the United States — engineered a coup, restored the Shah to near-absolute power, and left Mossadegh to die under house arrest in 1967. Yet he never flinched. His mother had taught him that a person's worth is measured by the hardships he will bear for his people — that the more he was reviled, the more ready he should be to serve. That story is not history; it repeats before us even today. Back home, the objection was never to a judiciary — only to one that discharges its constitutional duty. A court that checks power is called unacceptable; a court that serves it is the design. But history keeps its own ledger. Mossadegh is remembered with honour; the Shah is not. Il nous semble en effet que la Cour mérite largement ce prix pour son action passée (y compris celle de la Cour permanente à laquelle la CIJ a succédé) et récente (not. ses avis sur le climat et sur Gaza). With Mossadegh and his nationalization of the Iranian oil industry in 1951, in the name of Iran's permanent sovereignty over its natural resources. The UK seized the International Court of Justice, and lost, in the seminal Anglo-Iranian Oil case. Mossadegh was named the "Man of the Year" by Times in 1952. And then came Operation Ajax, and the removal of Mossadegh by the US and UK services. Yas Banifatemi a aimé ceciIt’s been an exciting time launching ZDR – Živa Dispute Resolution, and I’m grateful to Tom Jones and Global Arbitration Review for featuring this new chapter. A big thank you to Andrés Jana, Professor Dr. Maxi Scherer, Yas Banifatemi, Prof. Dr. Mohamed Abdel Wahab C.Arb, FCIArb and Alexander Fessas for their generous words and kind support. After more than 14 years at the ICC International Court of Arbitration, I leave with a heavy heart, but also with great enthusiasm for what lies ahead. I am deeply grateful for all that my time at the ICC has taught me and for the people I have had the opportunity to work with along the way. I had the rare privilege of seeing hundreds of disputes from the inside, spanning an extraordinary range of sectors, legal traditions, regions and languages. I am grateful to each and every one of our excellent colleagues who fought so hard for Robert and Khaled, our two clients that were unlawfully detained in Iraq for so long. Today, for the first time in 2014 days, they are with their families and loved ones once again. This is what it’s all about. 🙏Yas Banifatemi a aimé ceciSlaney Advisors is very proud to share that, after five and a half years of unlawful detention in Iraq, Robert Pether and Khaled Radwan are finally home with their families in Ireland and Egypt, respectively. Robert and Khaled are engineers who were detained while working on the new headquarters of the Central Bank of Iraq. Starting in June 2021, answering an appeal for assistance, Slaney’s founder, Peter G., assembled and led an international team of lawyers, all acting pro bono, to represent them. The representation involved bringing a case on their behalf before the United Nations Working Group on Arbitrary Detention, and years of subsequent legal and diplomatic efforts to secure their freedom. There were many moments when it seemed the saga would never be resolved, but the team persevered.
