Litigation has a way of simplifying the world. Less straightforward is the settlement. Behind a single party may be a coalition of executives, general counsel, or other stakeholders. Some control money. Some control litigation strategy. Some possess formal authority. Others have no formal authority at all but can make agreement practically impossible. As a result, one of the most important negotiations in a sophisticated commercial dispute may not be the negotiation occurring across the table. It may be the negotiation happening within one side. AAA Panelist David B. Coher explores how understanding and preparing for that internal process before mediation can fundamentally change how lawyers and mediators approach resolution. As the world becomes more interconnected, the challenges facing international dispute resolution are growing increasingly complex. Emerging technologies, evolving global relationships, and new approaches to resolving disputes are changing how the international arbitration community navigates conflict. The question is no longer simply how dispute resolution will adapt, but who will help shape its future. In May 2028, San Francisco will become a global meeting point for the international arbitration community as ICCA International Council for Commercial Arbitration (ICCA) 2028, cohosted by the AAA-ICDR and California Arbitration (CalArb), brings together leading practitioners, innovators, and thought leaders to exchange perspectives, challenge conventional thinking, and explore the ideas shaping the next generation of dispute resolution. Through collaboration, innovation, and a shared commitment to progress, ICCA 2028 offers an opportunity to move the conversation forward and help define what's next for international arbitration. Technology is best evaluated in practice. Practitioners need opportunities to work with emerging tools to understand where they add value, where their limitations emerge, and where appropriate boundaries belong. That’s the approach AAA has taken with Clearbrief. In 2024, AAA became the first dispute resolution services provider to make the platform available to its panel at no charge. The goal wasn’t simply adoption. Giving arbitrators the opportunity to use Clearbrief in their day-to-day work has also given AAA practical insight into where the technology adds value, where its limitations are, and how those lessons can inform future technology decisions. The latest AAA article shares how that learning is shaping its approach to technology and the future of arbitration. Read more: https://lnkd.in/eNbZ9qb7 Maya Markovich #LegalAI #LegalTech #Clearbrief

Construction disputes often involve highly technical issues, from scheduling delays and cost escalation to design deficiencies and scope changes. Having an arbitrator who understands the realities of how construction projects are designed and executed can make a meaningful difference. Industry Professional Arbitrators (IPAs) bring firsthand construction knowledge to the decision-making process, helping them understand complex technical evidence, identify key issues, and assess competing expert testimony. That expertise can also help streamline proceedings and focus hearings on the issues that matter most. In our latest blog, AAA Arbitrator Janet White, FAIA, and AAA Director of ADR Services Elsbeth Koefer explore the advantages that IPAs bring to construction disputes and the AAA Construction Panel.
